  • The works, supplies or services can be provided only by a particular economic operator for the following reason:
    • absence of competition for technical reasons
Explanation:

„In diesem Projekt wird auf Ergebnissen von Vorprojekten aufgebaut, in die die handelnden Personen auf Seite des Auftragnehmers eingebunden bzw. federführend tätig waren. In dem Zusammenhang hat sich dieses Team als dienstleistungsorientierter Geschäftspartner bewiesen. Das vorhandene branchenspezifische IT Know-How in Kombination mit der Kenntnis über den für dieses konkrete Projekt spezifisch relevanten Teil des Logistiksektors, insbesondere das durch die Vorprojekte aufgebaute Know-How in Bezug auf die anzubindenden IT-Systeme der Partner, ist für den Auftrag essenziell und in dieser Form bei alternativen Anbietern nicht vorhanden. Bei der Umsetzung des Projekts ist es notwendig die technischen Bedingungen der anzubindenden IT-Systeme der Partner (insb. der Betreiber von Paketstationen) bereits zu berücksichtigen, um sicherzustellen, dass diese Anbindung auch technisch möglich ist und den Systemanforderungen beidseitig entspricht. Weiters handelt es sich um eine geistige Dienstleistung, die in dieser Form nicht auf dem Markt beschaffbar ist. Dies ist darin begründet, dass es nach entsprechenden Marktrecherchen der letzten Jahre im Rahmen des Projekts „Wien – Out Of The Box“ bisher keine Plattform dieser Art gibt. Ein Anbieter mit einem „Standard-Produkt“ existiert folglich nicht. Vielmehr braucht es das oben bereits angeführte spezifische Wissen für die zielgerichtete Umsetzung. Aufgrund der zeitlichen Dringlichkeit zur Abarbeitung bedarf es darüber hinaus einer schnellen Projektabwicklung: schnelle Vergabe an einen eingearbeiteten Partner mit Vorerfahrung, der die Bearbeitung in der geplanten Projektdauer bewerkstelligen kann.
