Explanation:

Der Auftragnehmer hat als Hersteller die Hardware & Software entwickelt und nur sie bringt die Hardware & Software auf den Markt (ausschließliches Recht). Das gilt auch für entsprechende Ersatzteile.

Die Hard- & Software kann somit ausschließlich über den Auftraggeber bezogen werden, da dieser auch über die dazugehörige Softwaren & Lizenzen liefert bzw. verfügt.

Ein Teil der Festnetz Telefonanlage der Salzburg AG fällt unter die Kategorie kritische Infrastruktur, vor allem jener Teil für die Kraftwerks- und für die Netzsteuerung der Anlagen der Salzburg AG, betreut durch die Salzburg Netz GmbH.

Ein „OpenScape Trading Produkt“ für Leitstellentelefonie kann ausschließlich nur vom Hersteller betreut werden. Laut Hersteller können sowohl die Software als auch die Hardware, wie technische Baugruppen, technische Teile bzw. technische Komponenten nur über den Auftragnehmer bezogen werden. Lizenzen Dritter zur Nutzung dieser Baugruppen, technischer Teile bzw. technischer Komponenten bestehen demnach nicht.
