Award of a contract without prior publication of a call for competition in the Official Journal of the European Union in the cases listed below

Explanation:

Zum ordnungsgemäßen Betrieb der CityMobil Applikationen sind fortlaufend weitere Softwareentwicklungs- und Supportleistungen betreffend das Backend, die WienMobil App sowie MSP notwendig. Diese Leistungen können nur von der Upstream Mobility erbracht werden. Ein Wechsel des Auftragnehmers ist aus technischen Gründen, insbesondere auf Grund der ansonsten nicht gegebenen Kompatibilität mit den bisher auf der Grundlage der Rahmenvereinbarung und der 1. Ergänzungsvereinbarung von der Upstream Mobility erbrachten Softwareentwicklungsleistungen praktisch nicht möglich. Leistungen betreffend Weiterentwicklungen, die über eine Schnittstelle an WienMobil Web Frontend und WienMobil Monitor andocken sind nicht Inhalt der Ergänzungsvereinbarung.

Bei Wien Mobil App und der Sercive Plattform des Auftragnehmers greifen Weiterentwicklungen in die bereits vorhandene Software ein. Eine Ausschreibung würde voraussetzen, dass die WL über alle Rechte verfügen, was nur teilweise der Falle ist. Bei der bisherigen, stufenweisen Weiterentwicklung der Software kam zu einer Verflechtung der Urheberrechte des Auftragnehmers und WL, die kaum mehr, bzw. nur unter erheblichem personellem und finanziellen Einsatz zugeordnet bzw. abgegolten werden könnten. Die Integration eines weiteren Anbieters in die Softwarearchitektur bzw. neben der bestehenden Softwarearchitektur ist zwar technisch möglich, aber zeit- und kostenintensiv, da Parallelstrukturen aufgebaut werden müssen bzw. zusätzlichen Programmieraufwänden notwendig werden und hat zur Folge, dass sich die Weiterentwicklung verlangsamt und verkompliziert. Die Leistung würde sich durch eine Ausschreibung erheblich verteuern und – im Vergleich zur Weiterentwicklung aus einer Hand – auch verschlechtern. Die Tatbestandsvoraussetzungen des §206 Abs 1 Z4 BVergG liegen daher vor, da eine vernünftige Alternative zum Verhandlungsverfahren mit nur einem Bieter, bzw. eine Ersatzlösung nicht ersichtlich ist. Es kann für die Weiterentwicklung der Wien Mobil App und der Service Plattform ein Verhandlungsverfahren mit nur einem Bieter durchgeführt werden.
