Explanation:

Der ORF verfügt aktuell für den Fuhrpark am Medienstandort Küniglberg (derzeit 56 KFZ) bereits über eine modular aufgebaute web-basierte Softwarelösung der NexOpt GmbH für die Fuhrparkverwaltung samt Buchungssystem und Telematik-Integration samt den dafür erforderlichen Server- und Hardwarekomponenten und der Telematik-Hardware in den Fuhrparkfahrzeugen.

Der ORF beabsichtigt nun, diese bestehende und den technischen und funktionellen Anforderungen des ORF entsprechende Fuhrparklösung auf die dislozierten Standorte des ORF in Österreich (Landesstudios) zu erweitern, um in Hinkunft den gesamten Fuhrpark des ORF über die bestehende Fuhrparksoftwarelösung zentral verwalten zu können. Zu dem Zweck sind Telematik-Hardwaremodule samt Zusatzhardware und Verkabelungen für die außerhalb des Medienstandorts Küniglberg stationierten (derzeit 128) KFZ zu beschaffen, die mit der bestehenden webbasierten Fuhrparksystemsoftware (eigenes Protokoll) kompatibel sein müssen. Mit der bestehenden Fuhrparksystemsoftware der NexOpt GmbH ist ausschließlich die ebenfalls von der NexOpt GmbH vertriebene, nunmehr zu beschaffende Telematik-Hardware kompatibel. Die NexOpt GmbH verfügt über die ausschließlichen Nutzungs- und Vertriebsrechte für die erforderlichen Komponenten zur Integration in die bereits am Medienstandort Küniglberg des ORF bestehende Fuhrparklösung. Die einmaligen Kosten für diese Erweiterung (Telematik-Hardware, Splitter, Kartenleser, Access Control-Module samt Installation) betragen € 73.352,67 (exklusive Umsatzsteuer). Außerdem kommt NexOpt GmbH das ausschließliche Recht zu, die entsprechenden Änderungen und Updates an der bestehenden Fuhrparksoftwarelösung vorzunehmen, sodass auch Wartungs- und Serviceleistungen – diese Betragen € 5.190,00 (exklusive Umsatzsteuer) pro Monat für das gesamte System (bestehende Software, bestehende Komponenten am Medienstandort und Erweiterung für Landesstudios) – nur von NexOpt GmbH erbracht werden können.

Im Ergebnis kommt aus technischen Gründen sowie aufgrund des Schutzes von Ausschließlichkeitsrechten nur die NexOpt GmbH für die Erweiterung des bestehenden Fuhrparkmanagementsystems am Medienstandort Küniglberg des ORF auf die ORF Landesstudios in Betracht, sodass die Vergabe gemäß § 36 Abs 1 Z 3 BVergG 2018 im Verhandlungsverfahren ohne vorherige Bekanntmachung erfolgt.
