Es ergaben sich zusätzliche Leistungen aufgrund der Änderung des Grenzwertesfür Quarzstaub gegenüber dem Vertrag. Die Änderungen sind aufgrund vonUmständen erforderlich geworden, die ein seiner Sorgfaltspflicht nachkommenderAuftraggeber nicht vorhersehen konnte.

VII.2.2)Reasons for modification
Need for modification brought about by circumstances which a diligent contracting authority/entity could not foresee (Art. 43(1)(c) of Directive 2014/23/EU, Art. 72(1)(c) of Directive 2014/24/EU, Art. 89(1)(c) of Directive 2014/25/EU)
Description of the circumstances which rendered the modification necessary and explanation of the unforeseen nature of these circumstances:

Die gegenständliche Änderung war trotz gebotener Sorgfaltspflicht für den Auftraggeber nicht ersichtlich. Ein Wechsel des Auftragnehmers ist aus technischen und wirtschaftlichen Gründen nicht möglich, da die gegenständliche Vertragsänderung in einem engen wirtschaftlichen bzw. technischen Zusammenhang mit dem ursprünglichen Auftrag steht. Zudem würde ein Wechsel des Auftragnehmers für den Auftraggeber zu erheblichen Schwierigkeiten in der Auftragsabwicklung führen, da eine zeitliche Unterbrechung des Auftrages die termingerechte Realisierung des Projektes gefährden und auch unzählige Schnittstellenprobleme aufwerfen würde. In weiterer Folge wäre der Auftraggeber auch mit beachtlichen Zusatzkosten aufgrund von Einarbeitungen, Vorbereitungsmaßnahmen, unvermeidbare Parallelbearbeitung bzw. allfälligen Stehzeiten konfrontiert.
