      Die Systemlandschaft des AG zeichnet sich durch eine hohe Komplexität aus bedingt durch den einzigartigen Tätigkeitsbereich des AG als einer der größten Betreiber von Straßen und kritischer Infrastruktur innerhalb der EU und der damit verbundenen notwendigen Einhaltung starker Security-Richtlinien. Zudem ergeben sich gerade in Anbetracht der aktuellen wirtschaftlichen (und politischen) Entwicklungen Risiken sowohl für den Auftraggeber als auch den Auftragnehmer. Aufgrund dieser Komplexität ist mit einer aufwendigeren Einarbeitungszeit zu rechnen, und jeder zukünftige Wechsel birgt ein enormes Risiko im Bereich der kritischen Infrastruktur. Um aber den Wettbewerb nicht zugunsten von bereits für den AG tätigen Bietern zu verzerren, soll diese nicht zusätzlich ausgepreist werden. Die erhöhte Laufzeit versetzt somit systemfremde Bieter in die Lage, etwaige Einarbeitungszeiten und Risiken besser kalkulieren und abfedern zu können. Da es sich bei dem Vergabegegenstand um neu zu errichtende Leistungen handelt, ist mit einer jeweils vergleichsweise langen Vorbereitungs- und Aufbauphase zu rechnen, bevor der tatsächliche operative Betrieb starten kann. Zudem besteht für den AN der Bedarf, eine für den AG spezifisch eingerichtete Betriebsorganisation inkl. Einhaltung von SLA-Zeiten aufzubauen, die erst nach einer gewissen Einrichtungs- und Laufzeit zum Tragen kommt. Eine kürzere Vertragslaufzeit würde das Investitionsrisiko für die Marktteilnehmer erhöhen und damit den Wettbewerb einschränken. Aufgrund der oben dargestellten Gegebenheiten ist eine erhöhte Laufzeit der Rahmenvereinbarung notwendig, um den Zeitraum der Amortisation zu verlängern sowie eine wirtschaftlich sinnvolle Kalkulation zu ermöglichen und damit den Auftrag für eine breitere Zielgruppe von Bietern interessant zu machen.
