         Mit einem geeigneten Bieter, der ein ausschreibungskonformes Angebot gelegt und im Rahmen der Bestangebotsermittlung die meisten Punkte erzielt hat, soll eine Rahmenvereinbarung für das Gewerk „Garten und Grünflächengestaltung – Landschaftsgärtnerei“, Liefer- und Dienstleistungen für das MuseumsQuartier Wien abgeschlossen werden.

         Leistungsgegenständlich sind unter anderem insbesondere folgende Leistungen:

         • Ausführungsplanung / Anfertigung

         • Lieferung oder Miete von u.a mobiler Begrünung / Lieferung von Pflanzen und Lieferung von sonstigen Gartenmobilen (Rankhilfen, Trögen etc.) sowie die Bepflanzung der Pflanzen inklusive umfassende Beratung vorab und anschließende Betreuung,

         • Baumpflege, Grünflächenbetreuung (siehe Leistungsverzeichnis)

         • Lieferung „Frei Haus“ ins Museumsquartier, Museumsplatz 1, 1070 Wien (sowohl mit LKW < 3,5t als auch mit LKW > 3,5t),

         • Aufbau und Montage,

         • Gärtnerische Pflege (landschaftsgärtnerische Leistungen),

         • Etwaige Zusatzleistungen (nach Beauftragung),

         • Abnahme und Dokumentation,

          Als vergaberechtliche Option ist folgende Leistungsposition „Pflanzen / Setzen bzw. Einpflanzen von Bäumen im Hof des MuseumsQuartier ab dem Jahr 2026“ vorgesehen.

          All diese vergaberechtlichen Optionen berechtigten die Auftraggeberin lediglich diese Leistungen beim Auftragnehmer zu beauftragen ohne Durchführung eines Vergabeverfahrens. Die Auftraggeberin ist hiezu jedoch nicht verpflichtet und ist frei, diese Leistungen auch von Dritten zu beziehen. Der Auftragnehmer hat in solchem Fall seine Mitwirkungs- und Koordinationspflichten, insbesondere hat er zu berücksichtigen, dass auch Dritte diese Leistung erbringen können.

          Der Auftragnehmer hat keinen Rechtsanspruch auf diese Option und kann bei Nichtausübung keine Ansprüche geltend machen.
