II.1.4) Short descriptionNHSE wishes to appoint a Programme Delivery Partner (PDP) for the New Hospital Programme (NHP) to be the long-term partner to the programme. <br/><br/>NHSE is seeking expressions of interest from suitably experienced organisations with the capability of delivering a high profile and important professional services contract. The successful Tenderer (“Consultant”) will provide expertise in scheme design, programme and project management and commercial expertise to allow NHP to develop a more standardised approach to design and delivery, increase participation from suppliers in the health infrastructure market, and unlock efficiencies and accelerate delivery to allow NHSE to meet the Government’s commitment to deliver the biggest hospital building programme in a generation. NHP’s ambition is to transform operations across digital, clinical, and workforce workstreams, to identify requirements and translate these into national standards and policies, thereby improving benefits for patients and staff. The PDP interfaces with and supports transformation workstreams, for example supporting the transfer of learning from more advanced Trusts to later ones. The PDP will work with NHSE and NHS Trusts to ensure that the programmatic benefits are increasingly embedded in hospital design and delivery as these benefits are developed. <br/><br/>The scope of services and contractual requirements are more particularly described in the Selection Questionnaire Pack (SQP) and accompanying procurement documents.<br/><br/>Candidates are referred to the SQP and accompanying procurement documents and VI.3 Additional Information in this Contract Notice.

New Hospital Programme is an England wide programme. Services may be performed at various sites across England. PDP Services to be performed in the UK only.
II.2.4) Description of the procurementThe New Hospital Programme was created to deliver the biggest hospital building programme in a generation. The Conservative Manifesto in 2019 included a commitment that ‘[w]e will build and fund 40 new hospitals over the next 10 years’ and in October 2020, Boris Johnson, the Prime Minister at the time, announced a commitment to build 48 hospitals by 2030 (comprising 8 pre-existing schemes and 40 new hospitals). In May 2023 the government confirmed their commitment to deliver 40 new hospitals, and to establish the capability and capacity to deliver a longer-term pipeline of hospitals beyond 2030/31.<br/><br/>This procurement is for the long-term Programme Delivery Partner (PDP) for the New Hospitals Programme. Description of options:
1. Optional Scope - NHSE reserves the right to use the Contract for wider NHSE requirements beyond NHP (NHSE Ancillary Services) and is also procuring the Contract for and on behalf of DHSC and SCCL in respect of Optional Scope. Further information on Optional Scope is included in the accompanying procurement documents. See ITC paragraph 2.1.5 (Optional Scope) and ITC Appendix A1: Outline Scope. <br/>2. Permitted modification - Digital Delivery – NHSE intends to procure a digital delivery partner separately from the PDP. Due to the similar nature of the services and ability for greater integration and efficiencies, NHSE reserves the right (by way of agreement with the Consultant) to novate digital delivery services to the Consultant. Digital delivery may therefore form part of the PDP Scope of Services during the Contract duration. Accordingly, the anticipated scope of the digital delivery services has been included in this Contract Notice and accompanying procurement documents (including ITC Appendix A1: Outline Scope). <br/>3. Transfer to replacement contracting authority – NHSE reserves the right to transfer the Contract in whole or in part to another public body (or bodies) that during the term of the Contract assume NHSE’s delivery obligations (in whole or in part) to deliver the New Hospital Programme or new NHS hospitals through another iteration of the New Hospital Programme.<br/>4. Trust support - the Consultant will provide services to support NHSE and NHS Trusts to ensure that the programmatic benefits are increasingly embedded in hospital design and delivery as these benefits are developed. The PDP Services will also enable NHSE to support the Trusts in the delivery of schemes.<br/>5. Extension to duration of the Contract - NHSE reserves the right to extend the term of the Contract in whole or in part or any other combination for up to a further 4 years to no later than 31 March 2035. See VI.3 Additional Information in this Contract Notice for further information.

However, Candidates should note that NHSE reserves the right to use the Contract for wider NHSE requirements (Ancillary NHSE Services) and is also procuring the Contract for and on behalf of DHSC and SCCL in respect of Optional Scope (see ITC paragraph 2.1.5 (Optional Scope) for further information). Further, NHSE reserves the right to transfer the Contract in whole or in part to another public body (or bodies) that during the term of the Contract assume NHSE’s delivery obligations (in whole or in part) to deliver the New Hospital Programme or new NHS hospitals through another iteration of the New Hospital Programme.<br/><br/>9) II.1.5 / II.2.6 (Estimated Value): £307 million (excluding VAT) for the first 48 months of the Contract (in accordance with Public Contracts Regulations 2015, reg. 6(19)). For further information about the basis on which this estimate has been calculated and further information on NHSE’s estimated value over the whole Contract term (including the estimated values of the Optional Scope), please see the SQP. All estimated values included within this Contract Notice and the SQP are to be treated as estimates only and do not constitute a guaranteed or cap on spend under the Contract.<br/><br/>10) II.2.7) Duration of the contract: The duration of 126 months is the maximum possible duration for the Contract based on the NHP programme as at the date of this Contract Notice. However, the Contract with the successful Tenderer will be for an initial term of 6.5 years, subject to a unilateral break clause that may be exercised by NHSE after the first 4 years. In addition, NHSE reserves the right to extend the term of the Contract in whole or in part or any other combination for up to a further 4 years to no later than 31 March 2035 (or 10.5 years in total). Other dates and timescales in this Contract Notice and in the SQP are estimated and may be subject to change.<br/><br/>11) IV.1.1) (Type of procedure): NHSE is procuring the Contract in accordance with the competitive procedure with negotiation (CPN) pursuant to PCR 2015, reg. 29.<br/><br/>12) IV.1.4 and IV.1.5 (Information about negotiation): NHSE reserves the right not to conduct negotiations with Tenderers and may award the Contract on the basis of Initial Tenders without negotiation in accordance with PCR 2015, reg. 29(15). NHSE also reserves the right to conduct negotiations in successive stages in order to reduce the number of tenders to be negotiated in accordance with PCR 2015, reg. 29(19). Candidates are referred to the SQP for further information on how NHSE intends to conduct the CPN process.<br/><br/>13) A response to this Contract Notice does not guarantee that a Candidate will be invited to participate in negotiation. The award process may be terminated or suspended at any time without cost or liability to NHSE. NHSE does not bind itself to enter into any contract(s) arising out of the procedures envisaged by this Contract Notice. No contractual rights express or implied arise out of this Contract Notice or the procedures envisaged by it.
