This is a combined synopsis/solicitation for commercial items prepared in accordance with the format in Subpart 12.6 and Subpart 13.5, as supplemented with additional information included in this notice.

The Millennium Challenge Corporation (MCC) is a U.S. Government corporation that works with developing countries to promote sustainable economic growth to reduce poverty. Since its establishment in 2004, MCC has deployed more than $10 billion in development grants through compact and threshold programs across 40+ countries. For more information on MCC, please visit www.mcc.gov.This announcement constitutes the only solicitation; quotes are being requested.

(i) The solicitation number is 95332424Q0002. This solicitation is issued as a request for quotations (RFQ).

(ii) The solicitation document and incorporated provisions and clauses are those in effect through Federal Acquisition Circular 2024-01 (effective 2 November 14, 2023).

(iii) This solicitation is not a set aside.

(iv) Contract line-item number(s) and items are included in Section B of the solicitation.

(v) MCC’s seeks offers to provide FIDIC Legal Advisory support services regarding the use of the FIDIC Conditions of Contract, the legal interpretation and application of those Conditions, and the best practices of FIDIC Employers in the context of MCC’s and OGC’s review, negotiation, and oversight of MCC-funded programs in eligible countries.

(vi) Dates and places of delivery are included in the solicitation document. Acceptance is at the Government location and all deliveries are FOB destination.

Technical capability and past performance, when combined, are more important than price.

(x) The clause at FAR 52.212-5, Contract Terms and Conditions Required to Implement Statutes or Executive Orders -- Commercial Items, applies to this acquisition. See Section I for the additional FAR clauses that are applicable to this acquisition.

(xi) The contracting officer has determined that additional terms and conditions (MCC-specific clauses) are necessary for this acquisition. However, the terms and conditions are consistent with customary commercial practices.
