The Naval Air Systems Command intends to negotiate and award a sole source, Basic Ordering Agreement (BOA) with Martin-Baker Aircraft Company, Ltd. (MBA) of Higher Denham, United Kingdom for supplies and services related to MBA-produced ejection seats and subsystems on behalf of the United States Navy (USN), United States Air Force (USAF), and Foreign Military Sales (FMS) programs.
The proposed contract actions for the procurement are those for which the Government intends to negotiate with only one source under the authority of 10 U.S.C. 3204(a)(l) and FAR 6.302-1, "Only one responsible source and no other supplies or services will satisfy agency requirements."
The government does not possess or cannot provide the technical data package/drawings necessary to manufacture the item. As the sole designer, developer, manufacturer, and supplier of ejection seats for multiple USN and USAF aircraft platforms, only MBA has the requisite knowledge, technical expertise, required technical data, production tooling, facilities, and experience necessary to support engineering, manufacturing, testing, and logistics tasks associated with the MBA ejection seats.
THIS NOTICE OF INTENT IS NOT A REQUEST FOR COMPETITIVE PROPOSALS. Interested parties, however, may identify their interest and capability by responding to the requirement with a capability statement. The Government will consider all information received prior to the closing date of this sources sought/synopsis. Information received will be considered solely for the purpose of determining whether to conduct a competitive procurement. A determination by the Government not to compete the proposed contract modification based upon responses to this notice is solely within the discretion of the Government.
