INTENT TO SOLE SOURCE

Navajo Area Indian Health Services (NAIHS), Navajo Area Office Bio-Medical Department intends to negotiate a one-time, sole source, firm fixed priced contract with NAVAJO TRIBAL UTILITY AUTHORITY, Highway 12 North, Fort Defiance, Arizona 86504 for Utility Services. NTUA is the only authorized utility service provider in the region and currently provides utility services for Navajo Area Office. No other utility provider can provide identified services in the region. This acquisition is in accordance with FAR 8.405‐6(a)(1)(i)(B): Only one sources is capable of providing the supplies and services required at the level or quality required because the supplies or services are unique or highly specialized.

The proposed contractor shall provide utility services to Navajo Area Bio-Medical Shop located in Window Rock, Arizona 86515.

Utility Services include:

1. Electricity
2. Water
3. Gas

Sole Sources Authority cited FAR 8.405‐6(a)(1)(i)(B): Only one sources is capable of providing the supplies and services required at the level or quality required because the supplies or services are unique or highly specialized. NTUA is main distributor and benefits majority of government requirements and is only authorized distributor of utilities on the Navajo Reservation. Due to the particular requirements of this solicitation, the proposed vendor meets the needs of the requestor which are most advantageous to the Government in terms of economy, efficiency, reliability of services. Therefore, Navajo Tribal Utility Authority is the only vendor capable of fulfilling the requirements of Navajo Area Office Bio Medical Department.

This notice of intent to award a sole source contract is not a request for competitive proposals. There will be no solicitation available for competitive quotes. Only emailed responses will be considered. Any response to this notice must show clear and convincing evidence, that competition would be advantageous to the Government. Respondents are advised that the Government is under no obligation to acknowledge receipt of the information received or provide feedback to respondents with respect to any information submitted. Last day to provide affirmative written response is October 24th, 2023, 10am MST.

A determination by the Government not to compete the proposed procurement base upon responses to this notice is solely within the discretion of the Government. Information received will be considered solely for determining whether to conduct a competitive procurement in the future.
