Synopsis: Notice of Intent to Award a Sole-Source Contract
Announcement Number: NC-NA0000-23-01415 Project Title: Franklin Covey All Access Passes
The US Department of Commerce (DOC), National Oceanic and Atmospheric Administration (NOAA), Eastern Acquisition Division-Norfolk, VA office, Simplified Acquisition Branch intends to negotiate on a sole source basis, under the statutory authority of FAR 13.106-1(b)(1)(i), with Franklin Covey for FC All Access Passes software. The North American Industry Classification Code (NAICS) for this acquisition is 513210, Software Publishers a business size standard of $47 million.
Sole Source Justification
The All Access Passes (AAP) are available from a single source, Franklin Covey and not provided by a reseller. The Franklin Covey AAP is an item peculiar to Franklin Covey, and no other online provider will satisfy agency requirements. The unique or highly specialized qualities of the AAP is a library of well-established content in an easily accessible online site. The AAP also enables NOAA employees in multiple states, time zones and geographic locations the ability to participate in distance learning and live training. AAP incorporates 360 assessments into its online content, which allows employees to complete an assessment before and after a training to measure their progress based on input from supervisors, colleagues, and subordinates. Franklin Covey offers a combination of organizational and individual assessments, unlimited access to distance/live leadership and personal development training including the option to become certified to present vendor-owned content and tailor it to meet specific requirements, and also includes coaching services. The need for these services has been identified in our Federal Employee Viewpoint Survey results, our internal survey responses and outlined in our Strategic Plan.
Special Notice
This special notice is not a solicitation for competitive quotes, nor will one be posted on Contract Opportunities. However, if an interested party believes that it is capable of meeting the requirements and be in compliance with the above justification, they may submit substantiating documentation in writing within the open period of this notice. Responses can be sent via e-mail to Kelly.Parr@noaa.gov. Documentation will be evaluated solely for the purpose of determining whether or not to conduct this procurement on a competitive basis. A determination by the Government not to conduct a competitive procurement, based upon response to this notice, is solely within the discretion of the Government. Oral communications are not acceptable in response to this notice.
All responsible sources may submit a Capability Statement in accordance with the solicitation, which shall be considered by the agency if received on or before 4:00 PM EDT on August 31, 2023. The Capability Statement must contain material in sufficient detail to allow NOAA to determine if the party can meet all of the requirements.

DOC/NOAA Eastern Acquisition Division requires that all contractors doing business with this office be registered with the System for Award Management (SAM).
