(NCO) 7, VA Medical Center in Atlanta, Georgia on behalf of the Carl Vinson VA Medical Center in Dublin, GA intends to enter into a sole source procurement with Phigenics, LLC, 3S701 West
Avenue, Suite 100, Warrenville, IL 60555. The proposed contract action is The Contractor shall provide all labor, materials, and equipment necessary to complete environmental validation
testing of the potable, utility, SPS, dental and dialysis water systems to facilitate the Legionella Water Management Program for utility water as well as to provide continuous monitoring
equipment, in accordance with VHA Directive 1061, issued in August 2014. The repair is needed for the Legionella Water Management Program in addition to three Potable Water Analytic (PWA)
Advanced Monitoring Systems, maintenance for these systems, and validation testing at the Carl Vinson VAMC located in Dublin, GA, which the Government intends to solicit and negotiate
with only one source under the authority of FAR 13.501. This notice of intent is not a request for quotation. Interested parties may identify their interest in the requirement and
capabilities to Elizabeth.Gonzalez6@va.gov no later than 3:00 PM EST, Friday, May 26, 2023. Telephone inquiries will not be accepted. All information shall be furnished at no cost or
obligation to the government. The anticipated statutory authority for limiting competition is FAR 13.106-1(b)(2); only one source is capable of providing supplies required at the level of
quality required because the supplies are unique or highly specialized. NAICS 561210 Facilities Support Services with a size standard of $47M. (a)Gray market items are Original Equipment
Manufacturers (OEM) goods sold through unauthorized channels in direct competition with authorized distributors. This procurement is for new OEM medical/technical supplies,
medical/technical equipment and/or services contracts for maintenance of medical/technical equipment (i.e. replacement parts) for VA Medical Centers. No remanufacture or gray market items
will be acceptable. (b)Vendor shall be an OEM, authorized dealer, authorized distributor or authorized reseller for the proposed medical/technical supplies, medical/technical equipment
and/or services contracts for maintenance of medical/technical equipment (i.e., replacement parts), verified by an authorization letter or other documents from the OEM, such that the OEM
s warranty and service are provided and maintained by the OEM. All software licensing, warranty and service associated with the medical/technical supplies, medical/technical equipment
and/or services contracts for maintenance of medical/technical equipment shall be in accordance with the OEM Terms and conditions. (c)The delivery of gray market items to the VA in the
fulfillment of an order/award constitutes a breach of contract. Accordingly, the VA reserves the right to enforce any of its contractual remedies. This includes termination of the
contract or, solely at the VA s election, allowing the Vendor to replace, at no cost to the Government, any remanufactured or gray market item(s)delivered to a VA medical facility upon
discovery of such items. No solicitation will be made available. Information received will normally be considered solely for the purpose of determining whether to conduct a competitive
procurement. A determination by the government not to complete this proposed contract based upon responses to the notice is solely within the discretion of the Government.
