SPECIAL NOTICE SYNOPSIS

The U.S. Government intends to award a SOLE-SOURCE contract for INTEGRATED SOLID WASTE MANAGEMENT SERVICES to Republic Services, through its wholly owned subsidiary, Solano Garbage Company, for refuse collection and recycling services. This service will be for a period of 5 months from the date of award. A solicitation for a contract with a 5 Month Period for refuse collection and recycling services will be issued for this requirement and an award is expected to be made. The statutory authority for the sole source procurement is e.g., 10 United States Code 2304(c)(1) as implemented in Federal Acquisition Regulation 6.302-1(a)(2), Only One Responsible Source and No Other Supplies or Services Will Satisfy Agency Requirements, because of a Franchise Agreement established between City of Fairfield, California and Solano Garbage Company on 06 September 2011 and extended 15 March 2022 - 30 November 2025.

Background:

The City of Fairfield, California entered into a Franchise Agreement with the subsidiary of Republic Services, Inc., Solano Garbage Company. This franchise agreement was renewed by an amendment in March 2022. In accordance with 42 U.S.C. 6961, para (a) in part, "Each department... of the Federal Government... sub-para (a)(2) engaged in any activity resulting, or which may result, in the disposal or management of solid waste or hazardous waste, shall be subject to, and comply with, all Federal, State, Interstate, and Local requirements..." Failure to contract with Solano Garbage Company would be in violation of 40 CFR Sec. 255.33 and the local requirements for refuse collection services promulgated by the City of Fairfield, California.

Notwithstanding, any vendor that believes it is capable of meeting the requirement as stated herein may submit a response, which will be considered only if received no later than May 2, 2023, at 1 P.M. Pacific Time. Send to mark.le@us.af.mil no later than the aforementioned time and date.

A determination not to compete this requirement based on the responses to this notice is solely within the discretion of the government. Please note that any prospective offeror must be registered in the System for Award Management (SAM) at www.sam.gov in accordance with FAR part 4.11.
