The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights

Explanation:

No other reasonable alternative exists for this procurement. This procurement is required for essential medical image data migration from existing systems that Philips Healthcare have exclusive rights over, to the recently procured NIPACS+ system. The wider market was consulted when NIPACS+ was procured the contract for which was awarded in July 2022. The absence of competition is not a result of the artificial narrowing of the parameters of the procurement.
