II.1.4) Short descriptionLeicestershire County Council (the Council) is undertaking a open procurement process, in accordance with the Light-Touch Regime requirements of the Public Contracts Regulations 2015, to appoint a provider or providers to supply Residential Overnight Short Breaks Services for Disabled Children.
The Council promotes a model of empowerment that supports children to live a in a way that actively considers their needs, diversity and inclusivity. The primary aim of the service is to provide high quality residential short breaks care and where appropriate community-based outreach to children and young people with moderate to severe learning disabilities and complex health care needs who are assessed as needing such a service by Leicestershire County Council, Children and Family Service.
The requirement will be broken down into 2 lots:
Lot 1 - Children and young people with learning disabilities
Lot 2 - Children and young people with complex health care needs

VI.4.3) Review procedurePrecise information on deadline(s) for review procedures:
Leicestershire County Council (LCC) will incorporate a minimum 10 calendar day standstill period at the point of information on the award of the contract is communicated to Tenderers. LCC will ensure information on the award of the contract is communicated to all Tenderers. Tenderers who are unsuccessful shall be informed by LCC as soon as possible after the decision has been made as to the reasons why the applicant/ tenderer was unsuccessful.
If an appeal regarding the award of the contract has not been successfully resolved, the Public Contracts Regulations 2015 provide for aggrieved parties who have been harmed or are at risk of harm by breach of the rules to take legal action. Any such action must be brought within the applicable limitation period. Where a contract has not been entered into the Court may order the setting aside of the award decision or order for any document to be amended. The purpose of the standstill period referred to above is to allow the parties to apply to the Courts to review the award decision before the contract is entered into.
