Invitation to Submit Expression of Interest
For Consulting Services – Individual Consultant

Assignment Title : Environmental Assistant (National)
I. INTRODUCTION
1. The Government of the Democratic Republic of Timor-Leste has received financing from the World Bank (WB) towards the cost of Timor-Leste Branch Road Project (TLBRP). Part of this will be used for financing consulting services for the position of Environmental Assistant (National) for assisting the Project Management Unit of the Directorate of Roads, Bridges, and Flood Controls and Directorate General of Public Works.
For implementation purposes, the Ministry of Public Works (MPW) is the Executing Agency for the Project through the Project Management Unit (PMU).
2. The MPW will engage the services of qualified individual consultant, directly, or through a consulting firm to perform the services, as detailed in the Terms of Reference (TOR) hereto attached as Appendix I.
3. There will be a ranking of shortlisted consultants and the first ranked will be invited for financial negotiations and ultimately a contract between Consultant and the MPW. It is anticipated that contract negotiation with consultant would commence around Last week of August 2021 and the assignment would commence in September 2021.
4. The attention of interested Consultants is drawn to paragraph 3.14, 3.16 and 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers Fourth Edition, November 2020 (“the Regulations”), setting forth the World Bank’s policy on conflict of interest.
II. CONTENTS OF THE PROPOSAL
5. The curriculum vitae submitted together with the Expression of Interest will be used for the selection of the Consultant. The individual consultant should demonstrate the knowledge of his/her field in road projects.
6. The MPW requires that the proposal shall have the signature of the consultant and date of signing should be provided in the curriculum vitae.
III. TRANSMISSION ARRANGEMENTS
7. The Expression of Interest and detailed curriculum vitae should be prepared in English and should be submitted to the following contact details not later than 20 August 2021, 5:00 PM Timor-Leste time;

IV. EVALUATION OF CURRICULUM VITAE
8. The curriculum vitae will be evaluated, prior to the invitation for financial negotiation, on the basis of the qualification of the individual consultant to be assigned.
9. Following the completion of evaluation of curriculum vitae, the financial negotiation will be conducted with the Consultant.
V. FINANCIAL NEGOTIATION
10. Financial Negotiation will be via email to be relayed by the person indicated in III above, following MPW’s invitation to attend negotiation.
11. Representatives conducting financial negotiation on behalf of the Consultant must have written authority to negotiate financial matters and other terms and conclude a legally binding agreement.
12. The financial negotiation will generally request the Consultant the remuneration and the details of out-of-pocket expenditure items required for the services.
13. If contract negotiation fails for any reason, the MPW will invite the second highest evaluated Consultant in the shortlist.

I. Introduction
The World Bank (WB) under the Timor Leste Branch Road Project (TLBRP) will finance consulting services for the position of National Environmental Assistant of the Project Management Unit (PMU) under the Ministry of Public Works (MPW).
In order to carry out a series of planned and programmed road improvement projects the PMU under the MPW will engage the services of qualified individuals as consultants to conduct the required environmental safeguard activities of the Project; as detailed in this Terms of Reference (TOR).
II. Background Information
The Ministry of Public Works (MPW) of the Government of Timor-Leste (GOTL) has numerous road improvement projects in progress. The consulting services (the Services) requires a qualified individual consultant for the position of National Environmental Assistant for the Project Management Unit (PMU) in the National Directorate of Roads, Bridges and Flood Control (DRBFC) under the MPW to support the environmental management activities in line with the environmental compliance requirements.
The National Environmental Assistant (NEA) will support safeguards implementation on all projects in the purview of the PMU primarily assisting the National Environmental Specialist (NES) and International Safeguards Specialist (IRES). The NEA will be responsible to engage in such tasks as are delegated by the NES and IRES to ensure environmental safeguards meet GOTL and development partner requirements during the implementation of the ongoing and the future programmed projects.

The National Environmental Assistant will support the environmental management activities of the GOTL focusing on projects in the PMU and DRBFC portfolio. Tasks include, but are not necessarily limited to:
(a) Work with the International Resettlement and Environment Specialist (IRES) and the National Environmental Specialist (NES) to receive and undergo office and field based “on the job training” from the IRES/NES PMU to build capability. Subsequently be able to conduct field inspections and interact with PISC Consultants and report on implementation of the EMPs on various projects. Assist in report preparation to ensure compliance with all statutory and environment safeguard requirements for all projects within the purview of the Project Management Unit of the Ministry of Public Works.
(b) Assist IRES-NES to facilitate the ongoing capacity development activities to government and local counterparts, national consultants and contractors to ensure skills transfer for improved sustainability of investments. Proposed capacity building will include (a) awareness training of the DRBFC and PMU (including management) and contractors on environmental management in line with the international best practice and Timor-Leste requirements on environmental safeguards, (b) capacity building programs to improve the capability of environment staff at all levels in carrying out, and monitoring environmental management measures and (c) capacity building programs on environmental issues including environmental management requirements and implementation, pollution control, guidance on obtaining environmental licenses. The training programs will be conducted in Dili, selected district capitals and consultant and contractor facilities to be carried out in accordance with the training and capacity building program being delivered during implementation;
(c) In conjunction with the IRES-NES and National Resettlement Specialist (NRS) facilitate and participate in consultations as required for any project;
(d) Based on detailed engineering designs, work with the IRES-NES to update any environmental assessments already prepared or prepare environmental assessments for new projects in accordance with ADB, World Bank, JICA, EU or other development partners’ policies (e.g. World Bank Environmental and Social Framework (ESF) 2016 ADB – SPS, and the laws of Timor-Leste (particularly the Decree Law No. 26/2012 Basic Law of Environment and the Decree Law 05/2011 - Environmental Licensing);
(e) Assist PMU/ DRFBC in coordination with the Secretary of State for the Environment (SSE) to ensure that environmental safeguard measures for any project comply with country safeguard requirements including but not limited to (a) submission of the environmental assessment documents to SSE; and (b) submitting applications for environmental licenses under Decree Law 05/2011 (Environmental Licensing) on the prescribed forms and with the updated EMPs on the correct forms;
(f) Assist the IRES-NES review the contractor’s detailed construction methodologies and contractors’ site–specific EMPs (CEMP/ESMP[1]), Health and Safety Plan, Traffic Management Plan and monitor contractors’ compliance with its CEMP/ESMP (and other plans), and as necessary conduct on-site spot-checks of contractor’s mitigations and review contractor’s Monthly Reports regular monitoring reports for each subproject;
(g) Work with the IRES-NES to establish an environmental monitoring and reporting system within the PMU and contribute to Quarterly Progress Reports - including compilation of relevant items from Monthly Reports prepared by contractors - to be prepared by the PMU for DRBFC and World Bank.
(h) Assist PMU/ DRFBC in coordination with the National Authority for Petroleum and Mineral (ANPM) to ensure that material sources and quarry operation to be used for the project are comply with country legal frameworks as described in the Ministerial Diploma No. 64/2016.
(i) Assist and follow up the progress of the Contractor’s application on Environmental License for the projects’ ancillary facilities (basecamp, crusher plant, cement batching plant, asphalt mixing plant, sand washing, etc.,) and Mineral Licenses application for the sand and gravel quarries; and
(j) Assist the IRES-NES review the Contractor’s Site Clean-Up and Restoration Plan including the rehabilitation of quarries, borrow areas and spoil disposal areas.
IV. Reporting Requirements and Time Schedule for Deliverables
The National Environmental Assistant will be appointed for an initial period of twelve (12) months. Depending upon performance, the assignment may be extended.
At least 50% of the time of the National Environmental Assistant will be devoted to engaging in capacity building and training with the IRES and NES (recruited separately) and assist the IRES-NES to provide wider awareness raising and strengthening of Directorate of Roads, Bridges and Flood Control (DRFBC) and PMU staff (including management) and contractors in environmental safeguards.
The National Environmental Assistant will keep a daily activity diary and assist the IRES-NES to follow up the close out of the Corrective and Preventative Action Request (CPAR) issued to the Project Implementation Supervision Consultant (PISC).
The National Environmental Assistant shall be stationed at the PMU in Dili and will work under supervision and report to the IRES-NES on a daily basis but will also conduct site visits as required either individually, jointly with other stakeholders or with donor bank missions to properly meet the requirements of individual projects.
The National Environmental Assistant may need to work unsupervised in the field on some occasions to liaise with contractors and stakeholders and therefore ability to drive and speak other local and international languages will be an advantage.
