23/00572 Procurement of Service and maintenance - Cisco
Reference number: 23/00572The Norwegian Health Network SF (NHN) is a state enterprise owned by the Ministry of Health and Care Services and is the contracting authority for this procurement.
Our assignment is to develop, manage, and run national e-health systems and infrastructure. We ensure secure and effective interaction between stakeholders in the Health and Care Services.
Since 2017, NHN has provided ICT, procurement and archiving services to organisations in the central health administration.

The Norwegian Health Network SF would like to enter into a contract for yearly Service and Maintenance services for the Norwegian Health Network"s existing Cisco portfolio at all times.
An agreement will be sign, at the Smart Grid level, with one tenderer.
The Norwegian Health Network SF is covered by the Hospital Procurement Trust"s agreement for the purchase of network equipment, and all future procurements for the purchase of equipment will be made without including service and maintenance. Service and maintenance on purchased equipment will be continuously reported on the contract established in this procurement. The contract will grant the right to use licences, and the number of licences will be scalable, both up and down. HW procurement is not part of the contest, but support and maintenance will be provided for what already exists and may be included in the contract later on.
This is not an exclusive agreement and NHN reserves the right to purchase support along with HW and licences in other tender contests.
The contract will be regulated by SSA-V, SSA-B and associated appendices.
The contract has a duration of up to three (3) years with an option to extend for a further 1+1+1+1+1 years. The total duration of the contract is therefore set at a total of seven (7) years.

Tenderers must have orderly conditions with regard to payment of tax, employer"s national insurance contributions and VAT.

For Norwegian tenderers:
Tax and VAT certificate issued by the Tax Office via Altinn.
For foreign tenderers:
Foreign tenderers must submit equivalent certificates from their own country that show that they have orderly conditions in relation to the payment of tax and duties. If the authorities in the relevant country do not issue such certificates, the tenderer should submit a declaration stating that all taxes and duties have been paid. The statement must be approved and signed by the tenderer"s Financial Director/person responsible for finance.
Requirements concerning the tenderer"s registration, authorisation etc.
K1 - Tenderers must be a legally registered company.

Confirmation that the tenderer is registered in a trade register or company register in accordance with the law in the country where the tenderer is established.
Requirements for economic and financial position
Minimum level(s) of standards possibly required:K2 - The tenderer must have adequate economic and financial capacity to fulfil their obligations under the contract.
Economic and financial capacity must be documented by the following information for the legal applicant:
the last approved annual accounts for the two (2) last fiscal years with the annual report including the auditor"s report and any recent relevant information. The provisional fiscal figures for 2022 are wanted if they are relevant.
Solidity assessment from a company with a licence to run a credit information company. The evaluation must not be older than 3 months at the time of the application deadline, it must be based on the last approved fiscal figures and should report on the credit worthiness and degree of bankruptcy risk (bankruptcy prediction).
If a legal applicant relies on another company"s capacity to fulfil the economic and financial standing requirement, this company must also fulfil the qualification requirement and provide the documentation stated in point 1 and 2 above, in addition too a signed commitment statement, cf. annex 2, which explicitly states that the companies joint and severally guarantee the fulfilment of the contract.
The contracting authority will assess the figures based on turnover, profitability, solidity and liquidity.
Technical and professional qualifications and social responsibility requirements
Minimum level(s) of standards possibly required:K3 - Tenderers must have sufficient capacity and competence to fulfil the contracting authority"s need for assistance.
The requirement must be documented with the following information:
The tenderer"s relevant organisation for this delivery.
A description of the total competence and capacity that the tenderer has available for fulfilment of the contract in relation to the procurement"s purpose and need. Tenderers are asked to present an overview of the number of resources that are available, with a statement of relevant education and certificates.
A specification must be provided of which resources (the number of persons as well as a statement of relevant competence/experience) belong to the tenderer and which belong to other companies.
K4 - Tenderers must have established satisfactory methods for information security. The management system must comply with the Personal Data Act and the General Data Protection Regulation (GDPR).
The requirement is to be documented with a copy of a certificate for
information security (ISO27001/ equivalent) issued by accredited certification bodies.
Alternatively, a description can be given of the Tenderer"s systems for information security, as well as how they are implemented and managed in the organisation.
Tenderers must also give an account of the implementation measures for a new law on the processing of personal data and the General Data Protection Regulation (GDPR), even if
certification is presented.
The legal applicants must comply with the requirement If collaborating companies are involved, their information security system and implementation of the GDPR must also be described accordingly.
K5 - Tenderers must have a documented and implemented satisfactory quality assurance/management system.
The requirement is to be documented by presenting a copy of a quality assurance certificate (ISO9001/equivalent), issued by an accredited certification body.
Alternatively, a description can be given of the tenderer"s systems for quality assurance, as well as how they are implemented and managed in the company. The description must however be so detailed that the Contracting Authority can undertake an independent assessment of whether the tenderer"s quality assurance/management system can be considered well-functioning for this contract.
The legal applicants must comply with the requirement If collaborating companies are involved, their quality system must also be described accordingly.
K6 - Tenderers must have established satisfactory environmental management.
A brief and general description of the environmental management system the tenderer will use as the basis for the execution of the contract.
The description must however be so detailed that the contracting authority can undertake an independent assessment of whether the tenderer"s environmental management system can be considered well-functioning for this contract.
If a tenderer is certified by a public certification body (EMAS, Eco-Lighthouse, ISO 14001, or other recognised environment management systems or standards), it is sufficient to attach a copy of an issued certificate.
The requirement must be fulfilled by both the tenderer and any collaborating companies.
K7 - Tenderers must confirm that they have management systems for wage and labour conditions that ensure compliance with Norwegian law internally and with any contractors.
Who must fulfil the requirement:
- Tenderers
- If several multiple tenderers in the competition jointly (e.g. joint venture/working partnership), the requirement applies to each participant in the working partnership.
