Assignment Title: Procurement Specialist

The Government of the Republic of Marshall Islands has received financing from the World Bank toward the cost of the Marshall Islands Maritime Investment Project and intends to apply part of the proceeds for consulting services.

The consulting services (“the Services”) include individual consulting services to be provided by a Procurement Specialist who will be responsible for providing strategic procurement management services, procurement support and technical assistance to the whole World Bank projects portfolio in the Marshall Islands, in compliance with the applicable World Bank Procurement Regulations. The detailed scope of services is indicated in the Terms of Reference (TOR) for the assignment which can be found in Annex 1.

The duration of the services will be for twelve (12) with the opportunity to extend based on performance and the approval of World Bank financing. The position is a full -time position to be located in Majuro, the Republic of the Marshall Islands, the selected consultant shall be expected to commence services before end of August 2023.

The Division of International Development Assistance (DIDA) of the Ministry of Finance now invites eligible individuals (“Consultants”) to indicate their interest in providing the Services.

Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services (attach curriculum vitae with description of experience in similar assignments, similar conditions, etc.). Firms’ staff may express interest through the employing firm for the assignment and, under such situation, only the experience and qualifications of individuals shall be considered in the selection process. The criteria for selecting the Consultant are:

Required Qualification and Experience

  • Minimum Education: MA/MS (An advanced degree with a major in a relevant discipline e.g., Engineering, Law, Procurement, Finance, Business or Commerce).
  • Minimum 10 Years of experience in carrying out technical duties in public procurement or Donor/MDB financed project procurement
  • Experience with procurement systems, practices, and agencies in at least 2 different countries, with at least one being a developing country.
  • Excellent command of English
  • Advanced computer skills involve using the internet, word processors, spreadsheets, and websites to their fullest extent

The attention of interested Consultants (including firms) is drawn to paragraph 3.14, 3.16 and 3.17 of the World Bank’s Procurement Regulations for IPF Borrowers, dated July 2016, revised November 2017 and August 2018 (“the Regulations”), setting forth the World Bank’s policy on conflict of interest.

TERMS OF REFERENCE

PROCUREMENT EXPERT

Duration:

Two years -initial contract 1 year renewal subject to satisfactory performance of the incumbent’s duties and responsibilities.

Tentative Start Date:

August 15, 2023 (applicant must be available to mobilize to RMI by this date)

  • Background

The Republic of the Marshall Islands (RMI) is one of the Small Island Developing States which faces several development challenges, including small land area, limited resources, remoteness, vulnerability to natural disasters and external shocks, etc. The country consists of 29 atolls and five isolated islands (24 of which are inhabited) and has a total land mass of just 181km2, which is set in an ocean area of over 1.9 million km2. RMIs population is estimated at about 53,000, of which over half are resident in the capital city of Majuro.

The Government of RMI (GRMI) has partnered with the World Bank to implement development projects. There are currently ten (10) ongoing projects, as follows: a) Sustainable Energy Development Project (SEDP), b) Pacific Resilience Program Phase II (PREP Phase II), c) Pacific Islands Regional Oceanscape Program (PROP – Phase II), d) Budget Execution and Financial Reporting Project (BEFR), e) Maritime Investment Project (MIMIP), f) Early Childhood Development Project, g) RMI Covid-19 Emergency Response Project, h) RMI Education and Skills Strengthening Project, i) Urban Resilience Project, and j) Digital RMI Project.

The Ministry of Finance (MOF) oversees the overall implementation of the projects in close collaboration with other key stakeholders. A centralized unit within the Division of International Development Assistance (DIDA) has been established to provide fiduciary support to all the World Bank (WB) financed projects, including financial management, disbursement, procurement, safeguards, and communication.

To achieve this specific purpose, the Ministry of Finance through DIDA has established a Central Implementation support Unit (CIU) to provide implementation services to the entire World Bank portfolio

  • Project Description

DIDA is now seeking to engage a full time; in-country International Procurement Expert to provide the technical procurement support to all world bank projects and undertake a strategic procurement management role for the whole World Bank funded projects portfolio, including the management of the procurement specialist’s pool.

Specifically, the Procurement Expert will be working for the Division of International Development Assistance (DIDA), Ministry of Finance (MOF). The Procurement Expert will report to the CIU Program Manager and work under the overall coordination and supervision of the DIDA Assistant Secretary and CIU Program Manager. The Procurement Expert will assist the PIUs in managing the whole procurement process for goods and works and non-consulting services according to project Procurement Plan and the applicable GoRMI and World Bank’s Procurement Guidelines/Regulations

  • Objective

The objective of the services by the Procurement Expert is to undertake all activities and procedures for the procurement of goods, works and services according to the Grants Agreement and the World Bank Procurement Regulation for IPF Borrowers dated November 2020 (“the Procurement Regulations”), Guidelines on Preventing and Combating Fraud and Corruption in Projects Financed by IBRD Loans and IDA Credits and Grants,’ dated July 1, 2016 (“the Anti-Corruption Guidelines”), the Project Operational Manual, Project Procurement Strategy for Development (PPSD), Procurement Plan, and relevant GoRMI procurement requirements.

  • Scope of work

The Procurement Expert will liaise and coordinate closely with all project’s beneficiaries in the management and execution of the procurement portfolio. He/She will be supported by a team of 2/3 Procurement Specialists.

Specific responsibilities will include the following:

Project Establishment

  • Support the establishment of the Projects during their initial stages specifically with respect to procurement and support for the establishment and administration of contracts, and the establishment of policies, procedures, manuals, and systems to support procurement management and record keeping.
  • Establish the Procurement Plans in the online system, Systematic Tracking of Exchanges in Procurement. STEP
  • Assist with reviewing and updating the PPSDs and the Operations Manuals at the initial stage and during project implementation.
  • Develop, update, and maintain an appropriate database to support procurement management and record keeping.

Procurement Planning

  • Ensure STEP is always updated with procurement documentation.
  • Assist to /Update the PPSDs over the project, including:
  • Results of market analysis and engagement
  • Reviewing or preparing cost estimates for procurement activities.
  • Updating procurement approaches as relevant
  • Ensuring all procurement activities are reflected.
  • Ensure credible scheduling of all procurement activities, including checking that adequate financing is in place.
  • Establish a quality assurance mechanism for all procurement to be carried out as part of projects.
  • Review or prepare cost estimates for procurement activities.
  • Contribute to the development of the projects" annual planning processes.
  • Prepare the necessary procurement documentation for all procurements in consultation with appropriate technical experts.
  • Support the projects with the identification of potential suppliers, contractors, consultants.
  • Provide all support for any review or audit of projects’ procurement.
  • Ensure conformance to customs and taxation regulations in conjunction with the Finance officer.
  • Help to coordinate with shipping agencies/ brokers and suppliers on the delivery of goods for the project.
  • Coordinate with relevant departments to ensure appropriate asset management protocols.

Procurement Management

  • Lead the management of all projects’ procurement activities including the establishment of procurement panels and assessments in accordance with World Bank requirements, including:
  • Work with the technical working groups concerned with the preparation/review of technical specifications and terms of reference for contracts to be procured under the project in accordance with various procurement methods.
  • Prepare and publish procurement notices for any procurement category.
  • Draft Bidding Documents and Requests for Proposals and as necessary, submit for the World Bank’s prior review, including addenda.
  • Prepare tender opening reports, minutes of Bid/Proposal Conferences and clarification notices.
  • Guide the technical working groups and evaluation committees in the evaluation of proposals received, on the basis of criteria stipulated in the bidding documents.
  • Prepare the short list and short-listing report and as necessary, submit for the World Bank’s prior review.
  • Ensure preparation of comprehensive evaluation reports according to the World Bank standard forms and timely transmission of the Bid and Consultant Evaluation Reports to the World Bank for review and no objection.
  • Participate in contract negotiations for consulting services and provide guidance to negotiations team on topics which may be negotiated, and preparation of negotiation minutes.
  • Collaborate with the AG (Attorney General) in the preparation of contract documents.
  • Prepare the correspondence with bidders/consultants.
  • Manage complaints to the required business standards.

Contract Awards

  • Prepare all inputs to the Contract Award process including preparation of Notifications of Intention to Award; Debriefs; Responses to Complaints; and Contract Award Notices.
  • Represent the CIU /PIU at Procurement and Contract Award Committees and Meetings;
  • Advertise contract awards as required under applicable World Bank Regulation.
  • Assist in the preparation of all Purchase Orders and contracts for the provision of goods, works and services.
  • Manage the standstill periods and procurement complaints;

Contract Management

  • Create contract management roadmap and assign contract manager in STEP.
  • Support contract managers to keep the contract management module of STEP updated.
  • Ensure the timely procurement and support with monitoring delivery of goods, works, and services in accordance with contract conditions.
  • Maintain a combined list or register of all contracts awarded;
  • Monitor contract end dates and assists in the resolution of any implementation bottlenecks for component related contracts;
  • Support the preparation of contract management plans as appropriate.
  • Provide the Financial Management Specialists with the necessary assistance and information
  • Ensure conformance to customs and taxation regulations in conjunction with the Finance officers.
  • Support the PIUs to coordinate with shipping agencies/ brokers and suppliers on the delivery of goods for the project as required.
  • Coordinate with relevant departments and PIUs to ensure appropriate asset management protocols.

Monitoring, Reporting and Advice

  • Monthly reports to ensure up to date reporting on all procurement and contract milestones to the relevant Project Managers,
  • Support the development of the projects procurement risk management plan and ensure project procurement risks are identified and mitigated.
  • Prepare timely and accurate quarterly procurement reports including reporting against each project procurement plan and Key Performance Indicators (KPIs).
  • Provide procurement information as requested for management and review purposes.
  • Contribute to the delivery of quarterly monitoring and evaluation reports.
  • Contribute to the preparation of the six-monthly Progress Reports, for submission to the World Bank and the Project’s Steering Committee.
  • Ensure STEP is updated for the execution of all activities on a timely basis.
  • Provide details on project procurement for the PIU.
  • Provide files and documentation for Project Audits annually.
  • Liaise with representatives of the World Bank and Government Departments on matters relating applicable procedures to ensure that established guidelines, rules and regulations are adhered to.

Training/Capacity Building

  • Ensure projects staff receive appropriate training and capacity building in procurement procedures and systems.
