Section IV: Procedure
Software contractors develop their systems according to a distinctive methodology while using their preferred technology. The workforce of each contractor would have mastered a particular skill set where it would entail a significant effort for such workforce to switch to the methodology of another contractor. It is more feasible for software contractors to replace the solution entirely with their own product, rather than upgrade and maintain solutions developed by one of their competitors.
Engaging a different contractor without the knowledge of the system technicalities would require additional effort form this contractor that would ultimately reflect in higher costs. Furthermore, the risk of failure connected to these critical components increases since making changes to software that has been developed by a different party would introduce the risk of compromising the stability of the current systems.
This option would entail committing human resources that the Department does not possess through additional thorough testing of the complete solution. Testing the parts of the solution that have been upgraded requires less effort than testing the whole solution provided by a different contractor. Notwithstanding the fact that a different contractor may opt to upgrade the current solution, instead of replacing it with a new one, the Department will treat the upgraded solution as a new solution and will have to conduct a stringent User Acceptance Testing of the whole solution, since these components are considered critical components where no margin of error is acceptable.
Upgrades of this kind to the EMCS and SEED are necessary every year or so in view of newly implemented legislation that seeks to facilitate trade while reducing illegalities and evasion of taxes, namely Excise and VAT. It is not practical to issue a call for tender every time these types of upgrades are required. Furthermore, once the Department of Customs commits to a maintenance and support agreement with a particular contractor for several years, it is not legally possible to contract a different contractor to implement regulatory changes to the system unless the maintenance and support agreement with the contractor maintaining and supporting the system is relinquished.
