• Background

The Southern Africa Trade and Connectivity Project (SATCP), a World Bank-funded initiative, is dedicated to boosting economic growth and development in Southern Africa through enhanced regional trade. By investing in infrastructure and implementing trade facilitation measures, the project aims to reduce trade costs, improve efficiency, and stimulate economic growth.

As part of the projects ongoing efforts to strengthen value chains for regional integration the SATCP aims to Improve the productivity and market opportunities along specific value chains through a regional integration approach.

The Department of Animal Health and Livestock Development (DAHLD) is one of three Sanitary and Phytosanitary (SPS) implementing agencies under SATCP currently participating in the implementation of the component of strengthening value chains in Malawi. DAHLD plays a central role in supporting the country"s livestock trade by safeguarding animal health, promoting livestock development, and ensuring quality standards.

DAHLD has recognized the trade of Honey to be a promising market. To capitalize on this opportunity, there is a need to develop essential frameworks and regulations to govern honey production, processing, import and export. These measures will be instrumental in positioning Malawi as a competitive player in the global honey market while protecting the health and safety of consumers.

It is against this background that DAHLD, with funding from the world bank under SATCP, is commissioning a consultancy to develop the framework for honey regulations.

2.0 Objective of the Assignment

The primary objective of this assignment is to develop a comprehensive and robust regulatory framework for the honey industry in Malawi. This framework should encompass all stages of the honey value chain, from beekeeping practices to the final product, ensuring that it meets the highest quality and safety standards. By aligning with international best practices and market requirements, the regulatory framework will facilitate access to both domestic and international markets for Malawian honey producers.

A crucial aspect of this assignment is to create a regulatory environment that promotes sustainable honey production and trade. The regulatory framework should incorporate measures to protect bee populations, preserve biodiversity, and minimize the environmental impact of honey production. It should also address issues related to food safety, consumer protection, and fair-trade practices.

The ultimate goal is to develop a regulatory framework that positions Malawi as a reliable and competitive producer of honey on the global market as well as imports and exports. By establishing clear and enforceable standards, the assignment seeks to enhance the reputation of Malawian honey and attract investment in the honey industry.

3.0 Scope of Work

The consultant will be required to develop the regulation in line with the regional and international standards; to strengthen sanitary measures while supporting more efficient and effective delivery of sanitary services for cross-border clearance of honey and honey products.

3.1 Specific Tasks

The consultant will specifically undertake the following tasks;

• Conduct a thorough analysis of the current regulations in the region (SADC, COMESA) of countries such as Uganda and other international standards regarding honey, identify gaps in sanitary measures and sanitary service delivery in consultation with DAHLD and other stakeholders (including relevant trading partner countries i.e. Mozambique or Zambia). Based on the findings, the consultant shall provide recommendations that could enhance the regulatory and operational efficiency and effectiveness of sanitary service delivery system.
• Develop sanitary requirements for exportation and importation of honey and honey products including the conditions for export considering pest/disease situation in Malawi as well as new regional agreements and restrictions on sanitary measures.
• Update the list of bee diseases subject to import/export restrictions, including classifications (controlled vs. prohibited), and establish effective control measures for listed disease.
• Outline honey production requirements in relation to good husbandry practices.
• Develop fees schedule for regulatory actions for importation and exportation of honey and honey products and schedule for penalties for non-compliance with regulations.
• Develop standard operating procedures for exportation and importation of Bee’s and Bee products.

4.0 Deliverables

The deliverables expected from the consultant shall be reports of the development of honey Regulations including but not limited to the following:

• Inception Report detailing the methodology to be used in the review.
• Draft Reports:
• Comprehensive analysis of the current honey regulations in the region to identify gaps in sanitary measures and sanitary service delivery with recommendations that could enhance the efficiency and effectiveness of sanitary service delivery system
• A report of the developed standard operating procedures for imports and exports.
• Draft regulations (version 1) presented to DAHLD and other relevant stakeholders for comments.
• Draft regulations (version 2) incorporating comments on version 1 to be presented during a validation workshop.
• Final Regulations that incorporate feedback from the validation workshop.
• Process report.

5.0 Contract duration

The duration of the consultancy is 30 working days spread over two consecutive months (60 days) commencing from the date of signing of the contract.

6.0 Obligations of the consultant

Six (6) hard copies and one (1) soft copy (word format) of each deliverable should be provided to DAHLD (client) for review along with Power-point summary presentations. The consultant will also be required to make two (2) formal presentations to the client. The consultant is also required to deliver all expected deliverables timely in a manner and form approved by the client in addition to appropriately addressing all the comments raised by the client and stakeholders.

7.0 Obligations of the client

The Client will provide the following services to the consultant:

• Liaison with other stakeholders considered essential for proper execution of the assignment.
• Coordinate with other stakeholders to be engaged in the course of the assignment through provision of introduction letters to the consultant.
• Make timely payment to the consultant in line with the contract.

7.0 Payment schedule

20 per cent on delivery of accepted inception report.

50 per cent on delivery of the draft regulations (version 2).

30 per cent on delivery of accepted final regulations and process report.

8.0 Reporting and supervision

A Task Team led by DAHLD and comprising key government and private sector stakeholders in addressing honey issues will oversee this assignment. Key institutions for consultation while undertaking the assignment will include DAHLD, Ministry of Trade and industry, Malawi Bureau of Standards, Academia, Consumers Association of Malawi (CAMA), Malawi Bee Producers Association (MBPA), Department of Forestry, Department of National Parks and Wildlife, Malawi Veterinary Association (MVA), Pesticides Control Board (PCB) and Farmers Union of Malawi.

The Consultant shall submit all draft and final reports and deliverables to the Director of DAHLD through the Task Team Chairperson.

9.0 Composition and qualifications of the consultant

The consulting team shall be headed by a Team Leader/Lead consultant. Members of the team shall have the necessary qualifications to undertake the various tasks as set out in these Terms of Reference. The consultant shall possess the following expertise as part of the core team: (i) Animal Health expert (Veterinarian); (ii) Agricultural Economist (Trade) and (iii) Legal Expert. The experts are further described below:

• Animal Health Expert - Team Leader

Minimum requirements

• A minimum of a Master’s degree in Animal Health Preferably Veterinary Medicine or Animal Science and or any other related discipline.
• Good written and oral proficiency in English and good communication skills.

Professional experience:

• At least 10 years’ working experience in animal health or related field.
• Demonstrated knowledge of apiculture and honey production.
• Demonstrated experience in review of legislation or related field.
• Knowledge of Malawi animal health laws.

• Agricultural Economist (Trade)

Minimum requirements

• A minimum of a Master’s degree in Agricultural Economics specialising in agricultural trade or any related field.
• Good written and oral proficiency in English and good communication skills.

General Professional experience:

• At least 10 years working experience post-graduation in the relevant field.
• Experience in conducting agricultural trade analysis.
• Have specific experience in economic and financial analysis.
• Demonstrated experience in review of plant protection laws.
• Knowledge of Malawi plant protection laws.

• Legal Expert

Minimum requirements

• A minimum of a Master’s degree in law.
• Diploma in Legal drafting.
• Good written and oral proficiency in English and good communication skills.
• Demonstrated experience in review of laws.
• Knowledge of Malawi laws.

General Professional experience:

• At least 10-years of working experience in legal drafting.
• Demonstrated experience in review and drafting of regulations.
• Knowledge of Malawi laws.

N/B joint ventures are allowed

9.0 Conflict of Interest

The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and 3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” dated November 2020 (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
