The Government of Sint Maarten has received financing from the World Bank toward the cost of the Digital Government Transformation Project (DGTP) and intends to apply part of the proceeds for consulting services.
The NRPB is seeking to hire a full-time Legal Consultant to support the DLT and the Government of Sint Maarten in developing the required policies and legislations for digital transformation, by
a) facilitating the work of the external legal experts who are engaged through DGTP to prepare legislative and policy recommendations aligned with the eSXM strategy, and
b) provide needed assistance to the relevant stakeholders in coordinating the subsequent processes of review, consultation, and approval for new and amended draft legislation.
The consultant will be the primary liaison between the Department of Legal Affairs and Legislation, the DLT, the external legal experts, and other relevant government stakeholders on the draft legal amendments. The consultant will report directly to the Project Manager of the DLT, while maintaining working relations with relevant stakeholders and department of Legal Affairs.
The National Recovery Program Bureau (NRPB) now invites eligible consultants (“Consultants”) to indicate their interest in providing the Services. Interested Consultants should provide information demonstrating that they have the required qualifications and relevant experience to perform the Services, namely:
1. Education: A Master’s degree (LL.M.) in Law is required.
2. Specific experience: Excellent knowledge of the laws of Sint Maarten and/or The Netherlands, or Dutch Caribbean Islands, and international standards related to subject is required.
3. Legislative drafting experience: At least 5 years of experience in legislative drafting and legal research is required. Experience in implementing legal and regulatory frameworks, is preferred.
4. Familiarity with Sint Maarten"s Legal System: An understanding of Sint Maarten"s legal system, including its institutions, laws, and regulations, is preferred. However, the consultant must be able to absorb, adjust and navigate in new legal landscape if no prior experience in Sint Maarten.
5. Strong Analytical and Writing Skills: The consultant must be able to analyze complex legal and regulatory issues, recommendations to address those issues and develop clear and concise legislative amendments and policy changes. Strong writing skills are essential for drafting legislation and policy documents.
6. Communication and Collaboration Skills: The legal consultant must be able to communicate effectively (orally and in written form) with stakeholders at all levels, including government officials, technical experts, and the public. The consultant must be able to work collaboratively with other consultants and project teams to ensure the success of the project.
7. Language Skills: Fluent in English and Dutch both spoken and written are required.
Applicants are free to choose a format for their Expression of Interest. At this stage, Consultants are expected to provide:
(a) CVs including relevant information about qualifications and expertise, strategic competencies or achievements.
(b) Relevant references from previous similar projects/clients.
NRPB reserves the right to invite any or all interested candidates to an interview.
The attention of interested Consultants is drawn to Section III, paragraphs, 3.14, 3.16, and
3.17 of the World Bank’s “Procurement Regulations for IPF Borrowers” November 2020 edition (“Procurement Regulations”), setting forth the World Bank’s policy on conflict of interest.
A Consultant will be selected in accordance with the Open Competitive Selection of Individual Consultants as set forth in the Procurement Regulations.
