QUALIFICATION REQUIREMENTS
1. Administrative / Legal Qualification Requirements
Bidders must comply with applicable laws and regulations governing business operations.
Business License
Business licenses and classifications shall comply with the requirements specified in the Bidding Document.
Bidders must also:
Have a valid Taxpayer Status Confirmation issued by the relevant tax authority.
Own or legally control a business office with a valid, permanent, and verifiable address, either owned or leased.
Have the legal capacity to enter into a contract, evidenced by:
a. Deed of Establishment of the Company and its amendments (if any);
b. Power of Attorney (if the bid is submitted by an authorized representative);
c. Evidence that the authorized representative is a permanent employee of the company (if applicable); and
d. Valid National Identity Card.
Bidders must agree to submit:
Integrity Pact Declaration
Bidder’s Declaration Letter
If the Bidder intends to form a Consortium / Joint Operation / Partnership or other form of cooperation, a Consortium or Joint Operation Agreement must be provided.
2. Joint Operation (Consortium) Provisions
Joint Operations may be established between:
Non-small enterprises with non-small enterprises;
Non-small enterprises with small enterprises;
Non-small enterprises with cooperatives;
Small enterprises with small enterprises;
Small enterprises with cooperatives; and/or
Cooperatives with cooperatives.
The maximum number of members in a joint operation shall be:
Up to three (3) firms for Goods, Other Services, and Non-Construction Consulting Services of non-complex nature; and
Up to five (5) firms for Goods, Other Services, and Non-Construction Consulting Services of complex nature.
Other Administrative / Legal Requirements
Other administrative and legal qualification requirements shall be as specified in the Bidding Document.
TECHNICAL QUALIFICATION REQUIREMENTS
Bidders must have the following work experience:
a. At least one (1) contract for supply of goods within the same division (see table below) completed within the last one (1) year, in either government or private sector, including subcontract experience.
b. At least one (1) contract for supply of goods within the same group/category (see table below) completed within the last three (3) years, in either government or private sector, including subcontract experience.
c. For non-small enterprises, the highest value of similar contract within the last ten (10) years must be at least 50% of the Owner’s Estimate (HPS) or Budget Ceiling.
d. For small enterprises or cooperatives participating in procurement packages intended for non-small enterprises, the highest value of similar contract within the last ten (10) years must be at least 50% of the Owner’s Estimate (HPS) or Budget Ceiling.
Other Technical Requirements
Other technical qualification requirements shall be in accordance with the provisions specified in the Bidding Document.
