Administrative/Legal Qualification Requirements

Fulfilling the provisions of laws and regulations to carry out activities/businesses.

construction services business license: Participants who are business entities must have a construction services business license in the country of origin or its equivalent. Other administrative requirements must be met by the potential winner before the contract is signed.

  • There has never been a failure to implement a Non-performance contract or blacklisted due to default caused by the provider within 3 three years before the bid submission deadline date.
  • For the purposes of this qualification requirement, non-performance as decided by PPK includes all contracts where a the non-performance is not challenged by the provider, including through referral to the dispute resolution mechanism under the relevant contract, and b the contract is challenged but fully settled against the provider. Non-performance does not include contracts where the PPK"s decision is overturned through the dispute resolution mechanism. Non-performance must be based on any information regarding disputes or claims, i.e. disputes or claims that have been resolved in accordance with the dispute resolution mechanism under the respective contract and where all appeal cases available to the Participant have been resolved.
  • Possession of a Quality Management Certificate, Environmental Management Certificate, Occupational Safety and Health Certificate, and Anti-Bribery Management System Certificate or equivalent is only required for High Risk Complex Construction Works.
  • Minimum experience of 1 work contract with similar nature of work in the field of Building Construction that has been completed as a main provider, KSO member, management provider or sub-provider during the last 5 years from the deadline for bid submission, with a minimum contract value of Rp 32,604,334,400. – (Thirty Two Billion Six Hundred Four Million Three Hundred Thirty Four Thousand Four Hundred Rupiah) or a minimum of 2 two work contracts with a value for each contract of Rp 16,302,167,200.- (Sixteen Billion Three Hundred Two Million One Hundred Sixty Seven Thousand Two Hundred Rupiah) so that this requirement is fulfilled, the work quoted has at least 90 percent completion as evidenced by the Payment Certificate.
  • Have Core Experts with expertise qualifications as required and specified in the selection document.
  • Participants must have an average annual turnover of IDR 40,755,418,000.- (Forty Billion Seven Hundred Fifty Five Million Four Hundred Eighteen Thousand Rupiah) in the last 3 years calculated based on the value of construction work received each year based on the Company"s audited Annual Financial Statements in the last 3 years in 2021, 2022, and 2023 summed and divided by 3, and. have Financial Statements for the last 3 years 2021, 2022, and 2023 with a positive balance sheet and profit that has been audited by the Public Accounting Firm.
  • Prospective service providers must demonstrate the ability to gain access to, or have sufficient financial resources to meet the estimated cashflow needs of the implementation of the services of the Contract service name of the related package excluding other obligations of the Prospective Service Provider. The financial resources referred to are a minimum of Rp 8,151,083,600.- (Eight Billion One Hundred Fifty One Million Eighty Three Thousand Six Hundred Rupiah), and must be proven in the form of a bank statement from the service provider. In the event that the service provider participates in the auction of more than one work package, the bank statement submitted must be provided for each package followed and or ii Credit facilities outside the funds for payment of the Contract Advance in the form of a statement letter issued by a Public-Private Bank stating the availability of funds in the amount stated in the credit facility for the Mebidang Metropolitan BRT Development-Off Corridor Package work package, if later the Prospective Service Provider is determined as the winner of the auction.
  • Able to provide equipment to carry out this Construction Work the equipment may be self-owned or rented as required and specified in the selection document
  • In the event that the Election Participant is a KSO, the experience and resources of sub-contractors shall not be taken into account in determining whether the participant meets the qualification criteria, unless otherwise specified in the LDP.
  • The Election Participant shall make a Statement of Implementation of Civil Works Contracts that have been suspended or terminated and/or the Implementation Guarantee disbursed by the Service User for reasons related to non-compliance with environmental, or social, or health requirements, labour requirements, or occupational safety within the last five years.
