Angaben zur Leistung a) Art und Umfang der Leistung For over 90 years, the DAAD has supported more than 3 million academics in Germany and abroad. It is run as an association by German universities and student bodies. Its activities extend far beyond the awarding of scholarships: the DAAD promotes the internationalisation of German universities, strengthens German studies and the German language abroad, supports developing countries in establishing high-performing universities, and advises decision-makers on cultural, educational and development policy. As part of this call for tenders, the DAAD is seeking a service provider to offer specialist English language courses for teaching at two levels for approximately 70 participants annually - lecturers at German universities - whilst also designing and implementing a supporting programme covering culture and regional studies. The aim is to provide tailored language courses as well as insights into culture and regional studies. For further information, please refer to and the service description in Annex A02.

Minimum requirement:
The applicant must have achieved an average annual turnover (gross) of at least €400,000 over the last three financial years.
The applicant must have achieved an average annual turnover (gross) of at least €200,000 within the last three financial years in the area of activity covered by the contract (in the company’s business sector relevant to the contract) .
The requirement for an average total annual turnover of at least €400,000 or €200,000 over the last three financial years serves as objective evidence that the selected service provider possesses the financial capacity, stability and experience to ensure the reliable, high-quality delivery of intensive English language courses, including the extensive cultural and regional studies support programme for around 70 university lecturers annually, whilst complying with all contractual obligations.

Due to the particular complexity and organisational requirements - particularly with regard to the coordination of a large number of participants, the development and implementation of diverse didactic and intercultural programme components, and the adherence to high educational standards - specific performance and default risks exist. The turnover requirement ensures that only providers with demonstrably sufficient financial standing and experience - particularly with turnover in the field of activity covered by the contract - are commissioned, and who can guarantee sustainable, continuous and professional service delivery even in the event of unforeseen challenges.

or a declaration to take out appropriate insurance in the event of the contract being awarded and to maintain this for the entire duration of the contract.

Submission of suitable references for previously completed contracts in the form of a list comprising only the significant services provided in the last three years, stating the value, the date of delivery or performance, and the public or private client. A reference is considered suitable if the services provided were comparable to those advertised here, i.e. services in the areas of organising and delivering introductory and advanced specialist English language courses, including support for working professionals with a supporting programme.

Areas 1 to 5 must each be substantiated by at least two references (minimum requirement). A single reference may cover several areas.

14. Sonstige Angaben Alle Vergabeunterlagen werden in deutscher und englischer Sprache zur Verfügung gestellt. Im Falle von Streitigkeiten oder Auslegungsdifferenzen ist die deutsche Fassung maßgeblich. Der Vertrag wird mit dem bezuschlagten Anbieter nach Zuschlagserteilung und nach vorheriger Absprache entweder in deutscher oder englischer Sprache geschlossen. Unabhängig von der Vertragssprache findet ausschließlich deutsches Recht Anwendung (vgl. Rahmenvertrag, Anlage 03a)

All tender documents will be provided in German and English. In the event of any disputes or differences of interpretation, the German version shall prevail. The contract will be concluded with the successful tenderer, following the award of the contract and by prior agreement, in either German or English. Regardless of the language of the contract, German law shall apply exclusively (see Framework Agreement, Annex 03).
