3、Qualification Requirements For Bidder
Qualifications or Performance:3.1.1 A bidder shall be an independent legal person or other organization complying with the Bidding Law of the People"s Republic of China. Domestic bidders shall submit a business license or legal person certificate; overseas bidders shall submit local registration documents issued in their home jurisdictions.
3.1.2 An original or copy of a bank credit certificate issued by the bidder"s depository bank within three months prior to the bid opening date.
3.1.3 The bidder shall warrant that export of its equipment and software fully complies with applicable international and Chinese laws and regulations, and shall assist in completing all requisite import and export licensing formalities.
3.1.4 For domestic-origin products under this project, only bids from original equipment manufacturers (OEMs) shall be accepted. For overseas-origin products, bids are acceptable from either OEMs or authorized distributors. Where a bidder acts as an authorized distributor for the tendered goods, it shall furnish a valid authorization letter issued by the relevant OEM; the OEM and its authorized distributor shall not submit separate bids for the same tender.
Suppliers located outside China"s customs territory shall quote on a DAP basis only; suppliers within China"s customs territory shall quote on a DDP basis only. If an overseas supplier intends to bid via an agent, such agent shall also be an overseas entity and shall quote exclusively on DAP terms. Bidders supplying goods and services from outside China"s customs territory shall possess the capability to directly execute foreign trade contracts with the tendering party or its appointed foreign trade agent.
3.1.5 Consortium bidding is not permitted for this project.
3.1.6 Upon award of bid, the successful bidder shall execute a written contract in strict accordance with the tender documents and its submitted bid proposal, and shall not impose any unreasonable supplementary clauses or additional requirements on the tenderer.
3.1.7 Neither the bidder nor the OEM of the tendered goods has any material illegal records in business operations over the past year, including no bid rigging or fraudulent award via unfair competition, no major economic criminal cases, and no terminated contracts or adverse court judgments arising from its own breach of contract, illegal acts or violations of business ethics.
3.1.8 Performance Requirement The supplier shall provide sales evidence proving that the relevant OEM has sold no less than 4 units of identical-brand and same-type equipment worldwide from January 1, 2023 to the present (based on contract signing date). Documentation shall specify delivery date, corresponding customer name (customer codes are permitted in lieu of full legal names) and unit quantity per order.
During the bidding phase, excerpts of purchase orders, sales contracts or customer acceptance certificates containing core information shall be submitted. A signed commitment stating "All information provided herein is true and accurate; the bidder shall bear corresponding legal liabilities for any misrepresentation" with signature by authorized representative and official company seal must be attached to supporting documents. The tenderer reserves the right to inspect original performance certification materials when necessary. Separately, the bidder shall submit a performance authenticity undertaking in the format specified in the tender document.
3.1.9 The bidder shall complete and submit an enterprise profile form detailing organizational nature, registration particulars, business scope, relevant industrial qualification certificates (copies required) and other supporting documentation evidencing its capacity to fulfill the tender obligation. All documents shall bear the bidder"s official seal and guarantee factual accuracy.
3.1.10 To demonstrate compliance with all above qualification criteria, the bidder shall submit required supporting documentation as specified within its bid dossier.
