3、Qualification Requirements For Bidder
Qualifications or Performance:1) The bidder shall be an independent legal entity or other organization that complies with the provisions of the "Bidding and Tendering Law of the People"s Republic of China" (domestic bidders shall provide a business license or legal person certificate, while foreign bidders shall provide local registration documents);
2) Original or photocopy of the credit certificate issued by the bidder"s account-opening bank within three months prior to the bid opening date;
3) The bidder must commit to ensuring that the export of its equipment and software fully complies with relevant international and Chinese laws and regulations, and assist in handling all necessary import and export licensing procedures (providing a written statement in the format specified in Appendix 6-7);
4) For domestic products, this project only accepts bids from product manufacturers. For imported products, bids are accepted from both product manufacturers and authorized agents. If the bidder is an agent of the product, a valid authorization letter issued by the manufacturer of the selected goods must be obtained and provided. The manufacturer and its agent cannot participate in the bidding simultaneously (as specified in Attachment 6-5: Authorization Letter Issued by Manufacturer).
5) Foreign suppliers can only quote on a DAP basis, while domestic suppliers must quote on a DDP basis. If foreign suppliers require a bidding agency, the agency must be a foreign company and can only quote on a DAP basis. Bidders providing goods and services from outside China"s customs territory must have the capability to directly sign foreign trade contracts with the tendering party or its designated foreign trade agency.
6) If a bidder wins the bid, a written contract shall be concluded in accordance with the bidding documents and the winning bidder"s bid documents, without adding any other unreasonable clauses or additional requirements from the bidder (a written statement in the format of Appendix 6-7 shall be provided);
7) The bidder and the manufacturer of the bid goods have no major illegal records in their business activities within the past year, no instances of obtaining bids through unfair competition, no major economic or criminal cases, and no contract termination or failure to prevail as a defendant due to any breach, violation of laws, or breach of commercial ethics (provide a written declaration in the format specified in Appendix 6-7);
8) The bidding equipment provided by the bidder shall be a brand-new product of original origin (with a written declaration in the format specified in Attachment 6-7).
9) Performance Requirements: The supplier must provide sales records of the same brand and model of equipment for 12-inch processes, with a market sales volume of ≥【10】 units from January 1, 2023, to the present (based on the contract signing date). The records must include the equipment sales dates, corresponding customer names (customer names may be replaced with codes), and the number of orders. During the bidding phase, procurement orders, purchase contracts, or user acceptance certificates, including key information pages, must be submitted. The provided materials must include a statement such as "The above information is true and reliable. If it does not match the actual situation, we are willing to bear legal responsibility," signed by an authorized representative and stamped with the bidder"s company seal. The tendering party reserves the right to inspect the original sales performance documentation if necessary. (In addition to the above supporting documents, the bidder must submit a letter of commitment on the format specified in the tender documents to confirm the authenticity of the performance records.)
