3、Qualification Requirements For Bidder
Qualifications or Performance:(1)Requirements for Qualifications of the Bidder★
A.
If the Bidder is a company registered within the territory of China, it shall possess a legally valid Business License of an enterprise legal person, Tax Registration Certificate, and Organizational Code Certificate, or a unified business license combining these certificates. When submitting the bid, the Bidder shall provide a scanned copy of the original document (with the originals kept available for verification).
If the Bidder is a company registered outside the territory of China, it shall provide a valid certificate of company registration.
If the Bidder is a branch company, it shall possess a legally valid business license (for those registered within China) / certificate of company registration (for those registered outside China) and an authorization letter from the superior legal entity (authorizing the branch to bid and sign contracts). When submitting the bid, the branch shall provide scanned copies of the original documents (with the originals kept available for verification).
The qualifications, eligibility and performance of the branch and its superior legal entity shall be recognized by the Procuring Entity(Company/Purchaser), while the qualifications, eligibility and performance of other branches under the same superior legal entity shall not be recognized. Only one of the branch and its superior legal entity may participate in the bid; if both participate in the bid, all their bids shall be regarded as invalid bids.

B.Bid by an agent is acceptable
If the Goods to be offered by a bidder are not manufactured or not to be manufactured by the bidder itself, the bidder shall obtain a formal authorization letter from the manufacturer, permitting the bidder to offer such Goods in this bidding. The scanned copy of the original authorization letter must be provided and be included in the bidding document.
The bidder for this tender must be the manufacturer or agent of the laser analyzer body. If the bidder is not the manufacturer of the laser analyzer body, they must obtain a valid authorization letter from the manufacturer of the laser analyzer body being bid on.
If the bidder is an agent, the agent shall obtain the sole authorization from the manufacturer of the laser analyzer body for this bidding.
If a bidder participates in the bidding with goods manufactured by itself, the bidder shall not authorize other bidders to offer the same goods in the bidding at the same time; otherwise, all related bids will be rejected. If a bidder re-authorizes other bidders the authorized goods to participate in the bidding at the same time, all related bids will be rejected.
If the Bidder is a company in charge of sales within the manufacturer"s group, a statement should be provided indicating that the Bidder and the manufacturer belong to the same group and are responsible for the sale of the bid Goods.)

C. Is any bid by a consortium or a joint venture accepted? No.

D. Can a bidder participate in the bidding without purchasing the Solicitation Document? No.

(3)Requirement for Bidder"s Past Performance:
From January 1st, 2011 to the deadline for submission of the bid (subject to the signing time of the contract), the tender documents should meet the following performance requirements:
①The manufacturer of the product submitted by the bidder must have at least one contract experience in supplying laser analyzers, with a quantity of no less than 8 units in a single contract, and the design operating temperature no lower than 1000 degrees Celsius.
②If the bidder is an agent, they shall possess at least one agency performance record for laser analyzers with the manufacturer of the product being bid on, and must provide relevant documentation as proof of such performance.
The bidder shall submit the Performance Form in the specified format and provide the relevant performance certification documents. The performance certification documents include: Copies of sales contract.
The performance certification documents submitted by the bidder must include at least the following contents: the contract signing date; the contract signature page (China domestic trade contracts shall be stamped by the buyer and the seller, while international trade contracts shall be signed or stamped by the buyer and the seller); name of goods, quantity of equipment and the design operating temperature.
If the contract is an annual framework agreement, in addition to the agreement itself, the corresponding Purchase Order(s) (PO)(under which the goods were delivered) shall also be provided, and the purchase order content or PO numbering shall be associated with the annual framework agreement. Under the same annual framework agreement, one or more purchase orders.
Failure to submit the past performance certification documents, or inability to verify that the above performance requirements are met through the performance certification documents so provided, shall be deemed as invalid performance.
The performance of the products submitted by different manufacturers within the same
group (i.e., wholly-owned subsidiaries, holding subsidiaries or manufacturing plants
under the same group) is regarded as the performance of the manufacturer of the
products submitted by the bidder; the bidder should provide an explanatory letter to
state that the manufacturer of the products submitted in this bid and the manufacturer
of the products meeting the above performance requirements belong to the same
group.
