3、Qualification Requirements For Bidder
Qualifications or Performance:3.1 The Bidder is legal person or other organization that has purchased the bidding documents from the Tenderee or the Tendering Agent, and participated in the bid. Any legal person or organization that has not purchased the bidding documents from the Tenderee or the Tendering Agent is not allowed to participate in the bid.
3.2 This Invitation for Bids is open to all legal persons or other organizations from within the People"s Republic of China (hereinafter abb. as "PRC") and all countries/areas which have regular trade relations with PRC (hereinafter called "the eligible source countries/areas"), except as provided hereinafter.
3.3 Any legal person or other organization that has conflict of interest with the Tenderee and may have impact on fairness of the bidding is not allowed to participate in the bid.
3.4 Any legal person or other organization that has been entrusted to provide consulting service at the preliminary stage of the project or to prepare the bidding document is not allowed to participate in the bid, nor to prepare bid documents or provide consulting service to the Bidder.
3.5 Different bidders that have the same person in charge or have the relationship of share-holding or management should not participate in the bids for the same package.
3.6 The Suppliers may participate in the bids only if they are legally and financially autonomous, if they operate under relevant law, and if they are not a dependent agency of the Tenderee or the Tendering Agent.
3.7 Bidders should successfully complete registration on http://www.chinabidding.com (hereinafter abb. as "the Website") prior to the deadline for submission of bids stipulated in the bidding document. Otherwise, the bidders cannot enter into bidding procedures, and any consequence arisen thereafter shall be borne by bidders.
3.8 Joint Venture is NOT permitted for the Bid.
3.9 Agent is permitted for the Bid, however, a manufacturer can only entrust one agent to participate in this bid for equipment of the same model with the same brand and original Letter of Authority from Manufacturer stipulated in Volume One, Section 4: Formats of Bids IV-9-4 shall be submitted with the bidding document, or the related bid shall be deemed as invalid.
3.10 The bidder shall be either a manufacturer or an authorized agent of K1 & K3* SAFETY CLASSIFIED PRESSURE AND DIFFERENTIAL PRESSURE TRANSMITTERS. The manufacturer of K1 & K3* SAFETY CLASSIFIED PRESSURE AND DIFFERENTIAL PRESSURE TRANSMITTERS shall meet at least one of the following conditions:
1) Manufacturers from outside China Customs territory must have completed registration in accordance with China"s Nuclear Safety Regulations "Regulations on the Supervision and Administration of Imported Civil Nuclear Safety Equipment" (HAF 604) and provide supporting documents. The documents should include registration scope table. The scope of registration of equipment type shall include SAFETY CLASSIFIED PRESSURE or DIFFERENTIAL PRESSURE TRANSMITTERS.
2) Manufacturers from within China Customs territory must have obtained a permit in accordance with the provisions of the Chinese Nuclear Safety Regulations, Civil Nuclear Safety Equipment Design, Manufacturing, Installation and Non-destructive Inspection Supervision and Administration (HAF601), and provide supporting documents. The documents should include a list of permitted activity scope. The scope of the permit of equipment type shall include SAFETY CLASSIFIED PRESSURE or DIFFERENTIAL PRESSURE TRANSMITTERS.
3.11 The Bidder shall provide a complete qualification report, which shall contain qualification requirement for safety and severe accident. If the report cannot cover all the requirements, the bidder shall promise to supplement the qualification test, and ensure that the qualification test will not affect the equipment delivery progress. Please refer to Appendix VI-7 in Chapter 6 of Volume 2 of the bidding documents for the supplementary qualification test commitment letter.
3.12 Additional？Circumstance？in？which？a？Bidder？is？Prohibited:
1) Any collusive bidding that has been confirmed by "CNNCECP" portal.
2)The Bidder is on the CNNC supplier balcklist or grey-list, or on the blacklist for grey-list of the Tenderer or any of its specialized subsidiaries, and the listing is still within its validity period.
3)The Bidder, as a potential supplier, has been placed on the Company"s list of suppliers with undesirable conduct and has not yet been removed from that list.
4)The Bidder fails to meet the "two zero-tolerance" requirements of nuclear-safety regulation and has been explicitly ordered to suspend work by the nuclear-safety regulator.
