3、Qualification Requirements For Bidder
Qualifications or Performance:*(1) All Bidders are requested to fill in according to the requirements of Format IV-9 in Section IV and provide relevant information;
*(2) The bidder must be the manufacturer
Bidders whose products are of origin outside the customs must be manufacturers; Alternatively, it can be an agent directly authorized by the manufacturer (for imported products that have not entered the Chinese customs before the bid opening, the bidder must be a company registered outside the customs; for imported products that have entered the Chinese customs before the bid opening, the bidder must be a company registered within the customs). The agent bidding must meet the following conditions:
① The only formal authorization letter from the manufacturer for this bidding must be provided (the authorization letter must be directly authorized by the manufacturer, and secondary authorization is not allowed). The authorization letter should include the relevant content of "the manufacturer is responsible for the quality of the product and after-sales service" and the manufacturer"s contact person and contact method, and ensure that the manufacturer"s contact person can coordinate and handle important matters during the project execution process (for this requirement, the manufacturer may also issue a written commitment/explanation outside the authorization letter). Otherwise, proxy bidding will not be accepted;
② Bidders who have been registered locally in accordance with the law for at least three years from the bid opening date are required to provide valid copies of their business license and other registration documents;
③ Within three years from the bid opening date, bidders must have sales performance of similar products in at least two different years. They must provide copies of contracts or orders (at least two copies of contracts or orders from different years) or user certificates to prove their sales performance, and have them signed or stamped by the bidder"s representative.
*(3)The bidder whose product origin is within the territory of the Customs must be the manufacturer (agent bidding is not accepted)
*(4) If a bidder is subject to penalties from China National Petroleum Corporation (CNPC), China Petrochemical Corporation (Sinopec), and China National Offshore Oil Corporation (CNOOC) due to quality issues with the bidding products or poor contract execution prior to the bid opening date, and such penalties are still in effect (based on official penalty documents issued by bureau-level units or above), its bid will be rejected.
*(5) In accordance with relevant regulations such as the "Regulation on the Implementation of the Bidding Law of the People"s Republic of China" [Decree No. 613 of the State Council of the People"s Republic of China] (Article 74) and the "Implementation Measures for International Bidding of Mechanic and Electronic Products (Trial)" [Decree No. 1 of the Ministry of Commerce of the People"s Republic of China, 2014] (Article 76), the winning bidder shall sign a written contract within 30 days from the date of issuance of the notification of award. Otherwise, the bid inviter shall cancel the winning bidder"s qualification. )
*(6) If a bidder engages in fraud, collusion, bid-rigging, or interferes with the bid evaluation process by improper means, it shall be punished in accordance with relevant regulations such as the "Regulation on the Implementation of the Bidding Law of the People"s Republic of China" [Decree No. 613 of the State Council of the People"s Republic of China] and the "Implementation Measures for International Bidding of Mechanic and Electronic Products (Trial)" [Decree No. 1 of the Ministry of Commerce of the People"s Republic of China in 2014]. In addition, the bidder shall also be punished in accordance with the "Administrative Measures for the Procurement of Imported Materials of China National Petroleum Corporation".
*(7) If a bidder"s bidding qualification is suspended or cancelled by the China Petroleum Bidding and Tendering Network (www.cnpcbidding.com), its bid will be rejected. If a bidder violates relevant national laws and regulations, relevant provisions of the group company, or the principle of honesty and credit in the bidding, tendering, bid opening, bid evaluation, bid winning, and contract signing processes, according to the "Measures for the Administration of Bidder Discredit Behaviors of China National Petroleum Corporation", when the discredit score reaches 8 points, the bidder"s bidding qualification will be suspended for half a year; when the discredit score reaches 9 points, the bidder"s bidding qualification will be suspended for one year; when the discredit score reaches 10 points, the bidder"s bidding qualification will be suspended for two years. If the discredit score reaches 10.5 points or above, or if the bidder commits another discredit behavior during the suspension period, its bidding qualification within the group company will be cancelled for three years. If the bidder regains its bidding qualification upon expiration, the discredit score will not be reset to zero, and the validity period will be extended for three years. The above content shall be subject to the on-site query results of the bid evaluation committee on the corresponding website.
*(8) If a bidder is included in the blacklist of suppliers, contractors, and service providers of the China National Petroleum Corporation (CNPC) (the blacklist of suppliers, contractors, and service providers of the CNPC can be queried on the China Petroleum Bidding and Tendering Website/www.cnpcbidding.com), its bid will be rejected.
*(9) The bidder has not been ordered to suspend production or business operations, nor has its license or permit been temporarily suspended or revoked; it has not entered into liquidation procedures, been declared bankrupt, or otherwise lost its ability to perform the contract. A letter of commitment signed by the legal representative or authorized representative and stamped with the official seal must be provided.
*(10) Bidder product manufacturers who have delayed delivery and caused serious consequences in the execution of contracts signed with China Petroleum Materials Corporation in the past two years will be rejected.
*(11) Other Qualification and Achievement requirements stipulated in Chapter VIII.
Requirements for manufacturer qualifications and bidding product performance:
(1) Manufacturer qualification
The manufacturer of the bidding product must possess the capability to manufacture and sell such products (providing company profile, explanatory materials, and manufacturer registration certificate).
(2) Performance requirements for bidding products
The products for this bidding must be mature products, and experimental products are not acceptable; the manufacturer whose performance is provided by the bidder must be the manufacturer of the products for this bidding.
① Sales performance
During the period from 2020 to 2025, bidding products must have a sales performance of over 400 tons (the technical indicators of the performance products must meet the performance requirements specified in the technical specifications). Bidders are required to provide copies of contracts (which may not include prices), and the originals of the corresponding contracts must be provided for inspection during the bid opening.
② Usage performance
During the period from 2020 to 2025, the bidding product has demonstrated good performance in the use of suspended weighting cement slurry systems and drilling fluid systems in similar regions of China under high temperature (temperature ≥130℃) and high density (density ≥2.50g/cm3) conditions. The good performance of the cement slurry systems and drilling fluid systems under the simultaneous satisfaction of the above temperature and density conditions shall not be less than 2 well operations. The bidder is required to provide documentary evidence of the good performance of the bidding product, which shall include the well number, the type of fluid system used for well entry with suspended weighting, the density of the fluid used for well entry, the temperature and pressure conditions used, and the usage status (whether it is good or not). The supporting documents shall be confirmed and signed by the user, stamped with the official seal of a department-level or higher-level unit, and include the user"s contact information.
*(3) The bidder must provide a written commitment stating that it has not been included in the blacklist of suppliers, contractors, or service providers of the China National Petroleum Corporation (CNPC).
*(4) The bidder must provide the original or a copy of the credit certificate issued by the deposit bank within three months prior to the bid opening date, signed or sealed by the bidder"s representative.
