3、Qualification Requirements For Bidder
Qualifications or Performance:1) The bidding products shall complete effective registration in accordance with the "Measures for the Administration of Medical Device Registration and Filing" (Order No. 47 of the State Administration for Market Regulation) (copies of the medical device registration certificate and any possible change registration documents that match the licensing matters of the bidding products and are still valid at the bidding deadline shall be provided in the bidding documents).
2) If the bidding product is produced within the territory of the People"s Republic of China, the production enterprise and/or the commissioning party (applicable to commissioned production) shall obtain a valid production license in accordance with the provisions of the "Measures for the Supervision and Administration of Medical Device Production" (Order No. 53 of the State Administration for Market Regulation) (a copy of the license for producing the bidding product that matches the unit name, production address, and production scope and is still valid at the bidding deadline, as well as any possible change registration documents, shall be provided in the bidding documents).
3) If the procurement subject belongs to the second category of medical devices, the bidder shall complete the effective filing of the sales of the bidding products in accordance with the provisions of the "Measures for the Supervision and Administration of Medical Device Operations" (Order No. 54 of the State Administration for Market Regulation) (in the bidding documents, the bidder shall provide copies of the medical device operation filing documents and possible change filing documents that match the unit name, business premises, business scope, business mode, and warehouse address; this requirement only applies to domestic bidders for international bidding projects). If the proposed product belongs to the second category of medical devices whose safety and effectiveness are not affected by the circulation process and are recognized by the drug regulatory department of the State Council as exempt from business registration, the bidder shall provide the relevant product name list published by the National Medical Products Administration in the bidding documents.
4) If the procurement subject belongs to the third category of medical devices, the bidder shall obtain a valid business license in accordance with the provisions of the "Measures for the Supervision and Administration of Medical Device Operations" (Order No. 54 of the State Administration for Market Regulation) (the bidding documents shall provide a copy of the medical device business license that matches the unit name, business premises, business scope, business mode, and warehouse address, as well as any possible changes to the business license; this requirement only applies to domestic bidders for international bidding projects).
5) Within the three years prior to participating in the procurement activity (from November 11, 2022 to present), there have been no significant illegal records in the business activities (for this purpose, bidders must provide a written statement stating that there have been no significant illegal records in the business activities within the three years prior to participating in the procurement activity, and domestic bidders must provide a "certificate of no bribery behavior record", that is, the full text query results and query date on the "China Judgments Document Network" should be provided in the bidding documents, and stamped with the official seal of the domestic bidder); Overseas bidders must provide a written statement stating that they have no record of bribery.
