3、Qualification Requirements For Bidder
Qualifications or Performance:1) It must be a legal person or other organization with independent legal personality, and must not violate the provisions of national restrictions on operation, franchising, and laws and administrative regulations prohibiting operation;
2) The bidder shall provide an authorization letter for this project in the formal sales system of the bidding product in the bidding documents (note: the format of the manufacturer"s authorization letter in the bidding documents also applies to the authorization letter issued by the agent responsible for sales business in China in the formal sales system of the main equipment manufacturer. When such an agent issues the authorization letter, they shall also provide the manufacturer"s valid agency certificate for selling their products to the agent);
3) Bidders who use imported equipment for bidding and are unable to sign foreign trade contracts on their own must truthfully provide the "Authorization Letter for Signing Foreign Trade Contracts and Payment Matters (Bidders who can sign foreign trade contracts on their own do not need to provide it)" in their bidding documents (see Annex 6-3 for the format);
4) Bidders within the People"s Republic of China (excluding Hong Kong, Macau, and Taiwan) shall comply with Article 22 of the Government Procurement Law of the People"s Republic of China;
Therefore, bidders shall provide the following supporting materials and written statements in the bidding documents in accordance with Article 17, Paragraph 1 of the Implementation Regulations of the Government Procurement Law of the People"s Republic of China:
(a) Business license and other supporting documents of legal persons or other organizations;
(b) Bidders shall provide a written statement in their bidding documents stating their financial status and payment of taxes and social security funds (see Annex 6-1 for format);
(c) A written statement stating that there have been no significant illegal records in business activities within the three years prior to participating in government procurement activities (see Attachment 6-2 for format).
