3、Qualification Requirements For Bidder
Qualifications or Performance:1) The bidding products should be registered effectively in accordance with the "Measures for the Administration of Registration and Filing of Medical Devices" (Order No. 47 of the State Administration for Market Regulation) (copies of the medical device registration certificate that matches all licensing matters and is still valid at the bidding deadline, as well as possible changes to the registration documents, should be provided in the bidding documents).
2) If the bidding product is produced within the territory of the People"s Republic of China, the manufacturing enterprise and/or the commissioning party (applicable to commissioned production) shall obtain a valid production license in accordance with the "Measures for the Supervision and Administration of Medical Device Production" (Order No. 53 of the State Administration for Market Regulation) (copies of the production license for the bidding product that matches the unit name, production address, and production scope and is still valid at the bidding deadline, as well as possible changes in registration documents, shall be provided in the bidding documents).
3) If the subject matter of the procurement belongs to the second category of medical devices: The bidder shall complete the effective registration of the sales of the bidding products in accordance with the "Measures for the Supervision and Administration of Medical Device Operation" (Order No. 54 of the State Administration for Market Regulation) (the bidding documents shall provide medical device operation registration documents that match the unit name, business premises, business scope, business mode, and warehouse address, as well as copies of possible change registration documents; this requirement only applies to domestic bidders for international bidding projects). If the proposed product belongs to Class II medical devices whose safety and effectiveness are not affected by the circulation process and can be exempted from business registration after being recognized by the drug regulatory department of the State Council, the bidder shall provide the relevant product list published by the National Medical Products Administration in the bidding documents.
4) If the subject matter of the procurement belongs to the third category of medical devices: The bidder shall obtain a valid business license in accordance with the provisions of the "Measures for the Supervision and Administration of Medical Device Operation" (Order No. 54 of the State Administration for Market Regulation) (the bidding documents shall provide a medical device business license that matches the unit name, business premises, business scope, business mode, and warehouse address, as well as copies of possible business license change documents; this requirement only applies to domestic bidders for international bidding projects).
5) Within the three years prior to participating in the procurement activity (from June 21, 2021 to present), there are no major illegal records in the business activities (for this purpose, bidders must provide a written statement that there are no major illegal records in the business activities within the three years prior to participating in the procurement activity, and domestic bidders must provide a "certificate of no record of bribery behavior", that is, the full text query results and query date on the "China Judgment Document Network" should be provided in the bidding documents, and stamped with the official seal of domestic bidders); Overseas bidders must provide a written statement stating that they have no record of bribery. 6) The bidder must be the manufacturer of the bidding equipment or an authorized agent of the bidding equipment manufacturer (the agent must provide the manufacturer"s unique authorization letter for this project);
7) Bidders must submit their bids on an electronic trading platform for mechanical and electrical product bidding recognized by the Ministry of Commerce of China (hereinafter referred to as the "Mechanical and Electrical Product Trading Platform") before the bidding deadline.
