Cet Avis d’appel d’offres fait suite à l’Avis Général de Passation des Marchés paru dans le Journal des Marchés (JDM) le 14 mars 2023, dans le Cameroon Tribune du 17 mars 2023 et dans le système de Passation des Marchés de la Banque Mondiale (STEP) le 20 mars 2023

1. La République du Cameroun par le biais du Ministère de des Postes et Télécommunications (MINPOSTEL) a reçu un financement de la Banque Mondiale pour le Projet d’Accélération et de la Transformation Numérique au Cameroun, et à l’intention d’utiliser une partie de ce financement pour effectuer des paiements au titre du Marché relatif à l’acquisition et l’installation des infrastructures matérielles et logicielles pour le renforcement du CIRT National pour le compte de l’Agence National des Technologies de l"Information et de la Communication (ANTIC) dans le cadre du Projet d"Accélération de la Transformation Numérique du Cameroun (PATNUC). « Pour ce marché, l’Emprunteur effectuera les paiements en recourant à la méthode de décaissement de Paiement Direct, telle que définie dans les Directives de Décaissement de la Banque mondiale pour le Financement de Projet d’Investissement.

2. Le PATNUC sollicite des offres fermées de la part de soumissionnaires éligibles et répondant aux qualifications requises pour fournir l’acquisition et l’installation des infrastructures matérielles et logicielles pour le renforcement du CIRT National pour le compte de l’Agence National des Technologies de l"Information et de la Communication (ANTIC) dans le cadre du Projet d"Accélération de la Transformation Numérique du Cameroun (PATNUC).

3. La passation du Marché sera conduite par Appel d‘offres International Ouvert (AOIO) tel que défini dans le « Règlement de passation des marchés pour les emprunteurs sollicitant le financement des projets d’investissement (FPI), édition de septembre 2020 », et ouvert à tous les soumissionnaires des pays éligibles tels que définis dans le Règlement de passation des marchés.

4. Les soumissionnaires éligibles et intéressés peuvent obtenir des informations auprès de l’Unité de Gestion du PATNUC ; Tél : +237 222 232 628, Email : procurement@patnuc.cm , Sise à la Poste centrale, 1er étage du bâtiment annexe du MINPOSTEL situé entre la poste centrale et Eneo centrale, de 09 heures à 16 heures, heure locale et prendre connaissance des documents d’Appel d’offres durant les heures de bureau de 09h00 à 16h00 heures à l’adresse mentionnée ci-dessous. Le délai de réception des demandes d’éclaircissements, exprimé en nombre de jours avant la date limite de dépôt des offres est quatorze (14) jours.

5. Les Soumissionnaires intéressés et éligibles peuvent obtenir un dossier d’appel d’offres complet à l’adresse mentionnée ci-dessus sur présentation de l’original de la quittance de versement de la somme non remboursable de cent cinquante mille (150 000) Francs CFA, au Compte d’affectation Spécial CAS ARMP N° 335 988 60001 44 ouvert auprès de la BICEC. Il s’agit des agences de Yaoundé (Agence centrale), Douala (Bonanjo), Buéa, Ebolowa, Dschang, Ngaoundéré, Maroua, Limbe, Bafoussam, Bamenda, Garoua, et Bertoua.

6. Les offres devront être soumises à l’adresse suivante au plus tard le 16 Avril 2024 à 14 heures et seront ouvertes le même jour à 15 heures à l’Unité de Gestion du PATNUC ; Tél : +237 222 232 628, dans la salle de réunion de la CSPM -PATNUC située au rez-de-chaussée arrière de l’immeuble abritant la PKI de l’Agence Nationale de Technologies de l’Informations et de la Communication (ANTIC). La soumission des offres par voie électronique ne sera pas autorisée. Les offres remises en retard ne seront pas acceptées. Les offres seront ouvertes en présence des soumissionnaires ou leurs représentants dument mandatés.

7.Toutes les offres doivent comprendre d’une Garantie de l’offre d’un montant de : seize millions cinq cent mille (16500 000) FCFA.

8. Conformément au Règlement sur la Passation de Marchés exigeant que le PATNUC divulguera des informations sur la propriété effective du Soumissionnaire retenu, dans le cadre de la Notification d’Attribution du Marché, en utilisant le Formulaire de Divulgation de la Propriété Effective tel qu’il est inclus dans le document d’appel d’offres.

9. Les fournitures sont à livrer à l’Agence National des Technologies de l"Information et de la Communication (ANTIC) dans un délai maximum de neuf (09) mois.

10. Critères d’évaluation

10.1. Critères éliminatoires :

• Fausses déclarations, substitution ou pièces falsifiées ;
• Absence de déclaration sur l’honneur par laquelle le soumissionnaire certifie n’avoir pas abandonné de marché au cours des cinq (05) dernières années à savoir (2019, 2020, 2021, 2022, 2023), mais aussi, qu’il ne figure pas sur la liste des entreprises défaillantes de la Banque mondiale et celle annuellement établie par le MINMAP ;
• Absence des prospectus ou fiches techniques ;
• Non-respect des spécifications techniques majeures (cf page 97 du DAO)
• Non-respect d’au moins 5 des 6 critères essentiels.

10. 2- Critères essentiels

Pour qu’une offre soit retenue pour l’analyse financière, elle devra satisfaire tous les critères éliminatoires et au moins 5 des 6 critères essentiels :

10.3. Les critères de qualification à postériori applicables aux Soumissionnaires sont les suivants :

• Pour les soumissionnaires qui ne sont pas fabricants, fournir un certificat d’origine et une autorisation du fabricant leur permettant de vendre des biens dans le pays de l’acheteur et attestant que ces biens seront couverts par la garantie du fabricant et par l’obligation qu’il a de fournir des pièces détachées pendant le nombre d’années requis (03 ans).
• Fournir un certificat de conformité aux normes internationales pour tous les équipements proposés ;

Capacité financière : Le Soumissionnaire doit soumettre 1-des états financiers (synthèse des bilans ou le DSF) des trois (03 ans) dernières années (2021, 2022, 2023) certifiées par un expert-comptable Agrée, démontrant :1- la solidité actuelle de la situation financière du Soumissionnaire, 2- la réalisation des chiffres d’affaires annuels aux périodes sus indiquées tel qu’au moins, un de ces chiffres d’affaires annuel hors taxes représente au minimum 550 000 000 de francs CFA. Dans le cas d’un GE (Groupe d’Entreprises), cette exigence doit être respectée par l’un des membres du Groupement.

• Expérience et capacité technique : Le soumissionnaire devra fournir des documents attestant qu’il satisfait aux exigences en termes d’expérience : avoir exécuté au moins un (01) marché similaire (consistance et montant) au cours des trois dernières années ; disposer d"un Service Après-vente (SAV) fonctionnel (justifier d’un atelier équipé et un personnel qualifié (CV daté et signé, copie certifiée des diplômes d’au moins un ingénieur et un technicien).
• Non-exécution de marchés et litiges : Le soumissionnaire devra fournir des documents attestant l’absence de défaut d’exécution d’un marché au cours des cinq (5) années (2019, 2020, 2021, 2022 et 2023) précédant la date limite de soumission des offres, en se fondant sur toute information relative aux conflits ou litiges totalement réglés. L’ensemble des litiges en instance ne doit pas excéder 10% des actifs nets du soumissionnaire.

N.B. Le Maître d’Ouvrage Délégué procédera à la vérification de toutes les informations fournies avant l’attribution du marché. Toute fausse information fournie conduira au rejet

11. Durée de Validité des offres

Les soumissionnaires restent engagés par leur offre pendant cent vingt (120) jours à partir de la date limite fixée pour la remise des offres.

12. Attribution du marché

Le marché sera attribué au Soumissionnaire dont l’offre aura été évaluée la moins-disante et jugée substantiellement conforme au Dossier d’appel d’offres, à condition que le Soumissionnaire soit en outre jugé qualifié pour exécuter le Marché de façon satisfaisante (IS 19, 38 et 40).

13. Fraude et corruption

Les Directives Anti-Corruption de la Banque et la section VI « Règles de la Banque en matière de
Fraude et Corruption » du présent DAO sont applicables à la passation des marchés dans le cadre des Opérations de Financement de Projets d’Investissement par la Banque.

This Call to Tender is a continuation of the General Procurement Notice found in the Journal for Contracts (JDM) of the 14th of March 2023, in Cameroon Tribune of the 17th of March 2023 and in the World Bank’s Procurement System (STEP) of the 20th of March 2023.

• The Republic of Cameroon through the Ministry of Post and Telecommunication (MINPOSTEL) received some funds from the World Bank for the Program for the Acceleration of the Digital Transformation of Cameroon , and has the intention to use part of these funds to pay for Acquisition and installation of hard and software infrastructure to strengthen the National CIRT on behalf of the National Agency for Information and Communication Technologies (ANTIC) within the framework of the Program for the Acceleration of the Digital Transformation of Cameroon (PATNUC). « For this Contract, The Borrower will do the payments using the Direct Disbursement Payment Method, as defined in the Disbursement Directives of the World Bank for the funding of investment projects.
• PATNUC solicits sealed bids from eligible and qualified bidders for the supply of Acquisition and installation of hard and software infrastructure to strengthen the National CIRT on behalf of the National Agency for Information and Communication Technologies (ANTIC) within the framework of the Program for the Acceleration of the Digital Transformation of Cameroon (PATNUC).
• The Contract shall be awarded through an Open National Call to Tender (AONO) as defined in the « The Contract Award or Procurement Regulations for Borrowers soliciting funds for project investments (FPI), of the September 2023 edition », and opened to all bidders from eligible countries as defined in the Regulations for Procurement.
• Eligible and interested Bidders can get information from the PATNUC Implementation Unit; Tél : +237 232 628, Email : procurement@patnuc.cm , Situated at Poste centrale, 1st floor of the MINPOSTEL annex Building between the Central Post and Eneo central, from 9:00 am to 4:00 pm, local time and get a knowledge of the Call to Tender documents during working hours. The deadline for the reception of requests for additional information on the documents in number of days, before the final submission of bids is fourteen (14) days.
• Eligible and interested Bidders can get the full package of the Call to Tender Documents at the address mentioned above upon the presentation of the original copy of a receipt following the payment of a non-refundable sum of one hundred and fifty thousand (150 000) Francs CFA, to the ARMP Special Account N° 335 988 60001 44 opened at the following BICEC Branches: Yaoundé (Main Branch), Douala (Bonanjo), Buea, Ebolowa, Dschang, Ngaoundéré, Maroua, Limbe, Bafoussam, Bamenda, Garoua, and Bertoua.

• All Bids must comprise of a Guarantee to the tune of: (16 500 000) FCFA.
• In Conformity with the Procurement Regulations, which lays emphasis on the fact that PATNUC shall divulge vital specific information on the selected Bidder, within the framework of the Notification for the Attribution of Contract, using the Divulging Formula as presented in the Call to Tender Documents. 9. Supplies shall be done at the PATNUC Implementation Unit within a deadline of maximum nine (09) months.

10. Evaluation criteria

10.1. Elimination criteria:

• False declarations, substitutions or falsified documents;
• Absence of a declaration on honor by which the tenderer certifies that he has not abandoned any contract in the last five (05) years (2019, 2020, 2021, 2022, 2023), and also that he is not on the list of defaulting companies drawn up annually by the World Bank and MINMAP;
• Absence of prospectuses or technical data sheets;
• Non-compliance with major technical specifications.
• Non-compliance with at least 5 of the 6 essential criteria.

10. 2- Essential criteria

For a bid to be selected for financial analysis, it must meet all the eliminatory criteria and at least 5 of the 6 essential criteria:

10.3. The post-qualification criteria applicable to Tenderers are as follows:

• For bidders who are not manufacturers, provide a certificate of origin and a manufacturer"s authorization allowing them to sell goods in the buyer"s country and certifying that these goods will be covered by the manufacturer"s warranty and by the manufacturer"s obligation to supply spare parts for the required number of years (03 years). (see IS 19.1 A);
• Provide a certificate of compliance with international standards for all the equipment proposed;
• Financial Capacity: The Tenderer must submit 1 - financial statements (summary of balance sheets or the DSF) for the last three (03) years (2021, 2022, 2023) certified by a Chartered Accountant, demonstrating:1- the current soundness of the Tenderer"s financial situation, 2- the achievement of annual turnover for the periods indicated above such that at least one of these annual turnover figures excluding taxes represents a minimum of 500,000,000 CFA francs. In the case of a GE (Group of Companies), this requirement must be met by one of the members of the Group.
• Experience and technical capacity: The tenderer must provide documents proving that it meets the requirements in terms of experience: having carried out at least one (01) similar contract (scope and amount) over the last three years; having a functional after-sales service (proof of an equipped workshop and qualified staff (dated and signed CV, certified copy of the diplomas of at least one engineer and one technician).
• Non-performance of contracts and disputes: The tenderer must provide documents attesting to the absence of non-performance of a contract during the five (5) years (2019, 2020, 2021, 2022 and 2023) preceding the deadline for submission of tenders, based on any information relating to disputes or disputes that have been fully settled. All pending disputes must not exceed 10% of the bidder"s net assets.

N.B. The Delegated Contracting Authority will check all the information provided before awarding the contract. Any false information provided will lead to the rejection of the tenderer"s bid.

11. Period of validity of tenders

Tenderers remain bound by their tender for one hundred and twenty (120) days from the deadline for submission of tenders.

12. Award of the contract

The contract will be awarded to the Bidder whose bid is lowest evaluated or lowest bidder and determined to be substantially responsive to the Bidding Documents, provided that the Bidder is also determined to be qualified to satisfactorily perform the Contract (ITB 19, 38 and 40).

13. Fraud and Corruption

The Bank"s Anti-Corruption Guidelines and Section VI, "The Bank"s Rules on Fraud and Corruption," of this Contract Agreement apply.

The Bank"s Anti-Corruption Guidelines and Section VI "Bank"s Rules on Fraud and Corruption" of this OAD are applicable to procurement under the Bank"s Investment Project Financing Operations.
