The Australian Skills Quality Authority (ASQA) is the national regulator for Australia"s vocational education and training (VET) sector. ASQA is conducting a request for tender process to establish a Regulatory Panel. The ASQA Regulatory Panel is a multi-service pillar framework to support priority and regulatory activities requiring specialist skills. This approach to market is focused on specialist skills in training and assessment across the construction and early childhood education and care industries.

Other Instructions: Conditions for Participation:

The Conditions for Participation are listed in clause 7.1 of the RFT document.

The Conditions for Participation are mandatory minimum requirements that the Tenderer must meet before a Tender can be considered by ASQA.

Subject to section 6.8 of this RFT, any Tender that, in the opinion of ASQA, does not meet the Conditions for Participation at the Closing Time will be excluded from evaluation.

The Conditions for Participation that apply to this RFT are, at the Closing Time the Tenderer must:

- be a legal entity;

- not be bankrupt or insolvent;

- not be subject to any judicial decision against them (not including decisions under appeal) relating to employee entitlements and who have not satisfied any resulting order;

- not be listed as a non-compliant employer under the Workplace Gender Equality Act 2012 (Cth);

- in relation to Statements of Tax Record (STR):

- hold all Valid and Satisfactory STR(s) required for the Tenderer’s entity type;

- hold a copy of all Valid and Satisfactory STR(s) required to be held by any first tier subcontractor that it proposes, as part of its Tender, to engage to deliver goods or Services with an estimated value of $4 million or more (GST inclusive) if known at the time of submission; and

- submit with its Tender all Valid and Satisfactory STR(s) required for the Tenderer’s entity type (refer to the Note below) that is Valid and Satisfactory at the Closing Time; and

- hold the required levels of insurance (see clause 71.1 of Attachment C – Draft Head Agreement).
