The Department of Home Affairs (the Department) provides protection claims assistance to persons that are transferred to a Regional Processing Country (Transferees) and seek Refugee Status Determination pursuant to the 1951 Convention and Protocol relating to the status of Refugees. These services ensure that transferees understand the definition of a refugee, its relevance to the Refugee Status Determination process of the Regional Processing Country and to support their application for determination. These services:

a) Assist transferees to make their protection claim

b) Aid the preparation of applications for merits review where a transferee received a negative Refugee Status Determination and

c) Support transferees in judicial review and appeals processes.

The Department of Home Affairs invites interested parties to submit Tenders in accordance with this RFT for the goods and/or services described in the Statement of Requirement in Attachment A.

The Department intends to hold an Industry Briefing

Date: 18 March 2025

Location: Virtual – via Teams following registration

Time: 10.00 am (local time in Canberra, ACT, Australia)

As a condition of attendance at the Industry Briefing, attendees must sign a Deed of Confidentiality prior to the commencement of the briefing and deliver it to the Department. Those who will be attending the online Industry Briefing will receive invitations to MS Teams meeting via their contact information. Refer to Part 1, RFT Details for additional information.

Conditions for Participation:

The Department will exclude a response from further consideration if the Respondent does not meet the following conditions for participation:

a. The Tenderer holds all Valid and Satisfactory Statements of Tax Record (STR) Record required for its entity type; and

b. The Tenderer holds all Valid and Satisfactory Statements of Tax Record (STR) Record required for its entity type of any first-tier subcontractor that it proposes, as part of its response, to engage to deliver goods or services as part of a contract resulting from a procurement with an estimated value of $4 million or more (GST inclusive).

Tenderers should apply for a Statement of Tax Record and should ensure that their subcontractors apply for a Statement of Tax Record within sufficient time to meet these conditions for participation. Depending on their entity type, some Tenderers may need to apply for multiple Statements of Tax Record.

Tenderers will also need to meet the Minimum Content and Format Requirements:

a. the Tenderer must attach to their Tender a completed and signed copy of the Deed of Undertaking and Statutory Declaration substantially in the form set out in Attachment B;

b. the Department will exclude a response from further consideration if the response does not include all Valid and Satisfactory Statements of Tax Record relevant to the tenderer’s entity type;

c. the Tenderer must ensure that its Tender meets the following requirements:

i. Tenders must include a Pricing Schedule substantially in the form of Section 2 of Attachment C;

ii. all language, including in all attachments and supporting information, must be written in English; and

iii. unless otherwise specified in the Statement of Requirement, all measurements must be expressed in Australian legal units of measurement.

d. The Tenderer must provide details of how they identify, assess and address risks of Modern Slavery practices in the operations and supply chains used in the provision of the Goods and/or Services.

Timeframe for Delivery:

Initial contract term: Three (3) years from Commencement Date Options to extend: Up to three (3) additional periods not exceeding three (3) years in aggregate
