The works, supplies or services can be provided only by a particular economic operator for the following reason: protection of exclusive rights, including intellectual property rights

Explanation

In the short and medium term this Supplier is the only Supplier capable provider of this requirement due to the IPR position, rendering it impossible to exit or transition at this stage. The Contract being put in place as a result of this STA will rectify the IPR position and will give the Authority rights to use the IPR and therefore enable us to fully assess options for future delivery, including bringing some activities in house.
