To Develop the Workers/Employers Guide for Migrant Workers in Palau.

Objective

The main objective of this consultancy is to develop a comprehensive Workers/Employers Guide tailored to the needs of migrant workers in Palau. The guide will provide clear and accessible information on employment laws, workplace rights and obligations, contract terms, dispute resolution mechanisms, protection measures, and other relevant labour policies.

Background

The Republic of Palau hosts a significant number of migrant workers who contribute to various sectors of the economy, including construction, hospitality, fisheries, and domestic work. Migrant workers play a crucial role in Palaus economic development, yet they often face challenges related to employment rights, fair wages, working conditions, and access to legal protections.

Due to differences in language, cultural norms, and limited knowledge of Palauan labour laws, many migrant workers struggle to navigate the legal framework governing their employment. Employers, on the other hand, may lack adequate information on their legal obligations, which can lead to unintentional non-compliance and labour disputes.
To bridge this knowledge gap and promote fair labour practices, a comprehensive Workers/Employers Guide is needed. This guide will serve as a practical resource for both workers and employers, ensuring that labour rights and responsibilities are clearly understood and upheld in accordance with Palauan labour laws and international labour standards.
Scope of assignment
The consultant will be responsible for the following tasks:

Conduct a needs assessment to identify key information gaps and challenges faced by migrant workers and employers.
"
Review existing labour laws, policies, and international labour standards relevant to migrant workers in Palau.
"
Engage with key stakeholders, including government agencies, employers associations, trade unions, and migrant worker representatives, to gather inputs for the guide.
"
Develop an easy-to-understand, user-friendly guide that includes:

Background information that workers should know for working in Palau

Rights and responsibilities of migrant workers and employers
-
Information on employment related law, taxation and related information.

Employment contracts and working conditions
-
Wages, benefits, and social security
-
Workplace safety and grievance mechanisms
-
Information on banking and sending remittances
-
Place of worship
-
Health related information
-
Legal protections against discrimination, harassment, and unfair treatment
-
Sports, cultural information and community groups
-
Procedures for dispute resolution and access to legal aid
-
Contact details of relevant government agencies and support organizations
-
Consular assistance

Develop a dissemination strategy to ensure accessibility and usability by the target audience.
Project to which the consultancy is contributing
Pacific Climate Change Migration and Human Security Programme (PCCM-HS) Phase II programme contributes to strengthened resilience and adaptive capacity of Pacific Islanders in the context of climate change and disasters, ensuring that people can stay in place to the extent possible, that migration and planned relocation remains a choice, and displacement is averted, minimized and addressed. The programme will support the following outcomes:

Governments cooperate at the (Pacific) regional and sub-regional level to manage climate mobility (outcome 1);
"
Pacific Governments develop and implement national policies to address climate mobility (outcome 2);
"
Pacific civil society actors, worker and employer organizations, and communities actively engage in national, regional and global processes to manage climate mobility (outcome 3).
The programme is being delivered through a partnership between the International Organization for Migration (IOM), UN Economic and Social Commission for Asia and the Pacific (UNESCAP), International Labour Organization (ILO) and the Office of the High Commissioner for Human Rights (OHCHR), along with the Platform on Disaster Displacement (PDD) and Pacific Islands Forum Secretariat (PIFS).
Deliverables

Inception report outlining methodology, work plan, and stakeholder engagement strategy.

Draft Workers/Employers Guide for review and feedback.
"
Presentation of the guide to key stakeholders.
"
Finalized Workers/Employers Guide incorporating stakeholder inputs.
Duration and timeline
The consultancy is expected to be completed within three months from the date of contract signing. A detailed work plan with specific milestones will be agreed upon at the inception stage.
Required qualifications and experience
"
Experience in developing user-friendly publications and training materials.
"
Advanced degree in labour law, social sciences, or a related field.
"
Proven experience in migrant worker rights, labour law etc.
"
Strong research, analytical, and writing skills.
"
Ability to engage with diverse stakeholders and synthesize complex information into accessible content.
"
Familiarity with the labour and migration context in Palau or similar settings is an asset.
