The Fundamental Principles and Rights at Work (FPRW) on Forced Labour and Child Labour in Malaysia Project (Electrical and Electronics sector) aims to assist Malaysia in improving labour rights and working conditions, particularly for vulnerable workers, through a broader and more sustainable approach. More specifically, it seeks to address forced labour and child labour issues in Malaysias manufacturing sector, including the electrical and electronics (E&E) sector. The project is designed to enhance national and sectoral actions to adopt law and implement international labour standards in Malaysia, and to promote freedom of association and the right to collective bargaining. It also supports Priority 1: Rights at Work - protecting and promoting rights at work of the Decent Work Country Programme in Malaysia.
Furthermore, the project supports the implementation of Malaysias National Action Plan on Anti-Trafficking in Persons 3.0 (NAPTIP 3.0), which identifies manufacturing as a sector
confronted with human trafficking and forced labour, and seeks to support the Malaysian government in its effort to combat the issues.
The project is also in line with Strategic Goal No.4 of the National Action Plan on Forced Labour (NAPFL 2021-2025), which aims to ensure that victims of forced labour will have
improved access to remedy, support and protection services, while systems to prevent forced labour will be improved in high-risk sectors including manufacturing.
Suggested key stakeholders include: Ministry of Human Resources (MOHR), Ministry of Home Affairs (specifically the Council for Anti-Trafficking in Persons and
Anti-Smuggling of Migrants, the Royal Malaysian Police and the Immigration Department), Ministry of Women, Family and Community Development, Attorney Generals Chambers, the Malaysian
Employers Federation, the Malaysian Trades Union Congress (specifically the Electrical Industry Workers Union), the Electrical and Electronics Association of Malaysia, the Federation of
Malaysian Manufacturers, diplomatic missions of labour-sending countries, local authorities and relevant parliamentarians, as well as civil society organisations working on addressing
forced labour, child labour and human trafficking issues.

In delivering output 1.1 of the project, the ILO is seeking for a national consultant to support the implementation of the FPRW project team in conducting a study on Malaysian forced labour and child labour laws and the enforcement of the policies, and assist the Malaysian authorities in strengthening the enforcement of forced labour and child labour laws through institutionalizing the existing training programmes for labour inspectors.
The national consultant will conduct a study on Malaysian forced labour and child labour laws and the enforcement policies, specifically their victim-centeredness, gender- and
age-responsiveness, as a follow-up to recommendations of ILO supervisory mechanism.
The external collaboration contract will be issued to a consultant followed by the first meeting to brief the consultant about the assignment. Decent Work Team (DWT) - Bangkok will
employ high participatory approach and work closely with the consultant in each step of the work. Periodic catch-up meetings will be set up with the consultant. The consultant is
encouraged to reach out to relevant ILO technical specialists/project staff, and the identified stakeholders (individuals/organisations) for consultation where necessary. Both
quantitative and qualitative methods of analysis will be used to analyse the data. Resources for this consultancy will be from the projects budget and it is expected to be completed by
31 March 2024.

The National Consultant is expected to undertake the assignment as specified above. Payment will be made in one instalment upon satisfactory receipt and
approval of the following deliverables:
1. Annotated Outline of the Study, 20 February 2024 (10 workdays)
2. First draft of the study for review by the ILO, 26 March 2024 (20 workdays)
3. Final draft of the study, 31 March 2024, (10 workdays)
