Care and Support Statutory Advocacy (Care Act and IMCA)
Warwickshire County Council and Coventry City Council are seeking either a single provider or a partnership bid to deliver Care Act Advocacy and Independent Mental Capacity Advocacy (IMCA) across Coventry and Warwickshire.
Generally within the Council boundaries of Warwickshire County Council and Coventry City Council.
Care Act Advocacy will cover duties for s67 and s68 within the Act. It will be for indiviudals who are entitiles to advocacy services under the Care Act 2014 to enable them to fully participate in their Assessment, Care and Support Planning, Adult Safeguarding and Reviewing enquiry process.
Under the Mental Capacity Act the Local Authority has a duty to provide an independent advocate for people who lack the capacity in certain circumstances when there are no known relatives or close friends to speak for them. This includes people whom are:
— covered by the Mental capacity Act (2005) — The individual has no one other than paid staff with whom “it would be appropriate to consult”. The Code of Practice 10.74 — 10.78 provides more information about how this decision can be made.
The initial contract period will be 3 years with the option to extend for up to 2 further years.
These services may be subject to other modifications and changes in order to meet the changing needs and demands of the Council(s) and the customers. This may also be as the result of additional or reduced funding stream.

The Council will undertake its financial assessment of the tendering organisation (and if considered necessary by the Council, any partners within a consortium bid) based on its own evaluation of the tenderers" most recent 2 years accounts (or if 2 years accounts are not available, equivalent evidence which confirms financial viability). The assessment of accounts will be supported by an independent credit reference report from Credit-safe where this is available. The Council may also impose a Bond or Performance Guarantee on the successful Tenderer. Minimum level(s) of standards possibly required: Evidence as stated in the tender documentation.
