1) This Invitation for Tenders follows the General Procurement Notice for this project which was published on the European Bank for Reconstruction and Development (the Bank) website, Procurement Notices (www.ebrd.com) on 17.1.2018.
2) Municipal institution (legal form under Tajik legislation) „Housing and Communal Production and Maintenance Enterprise of the City of Yavan” (in Tajik PAЁСATИ КОММУНАЛИ - ИСТЕХСОЛИ ВА ИСТИФОДАИ МАНЗИЛИИ ШАХРАКИ ЁВОН“) hereinafter referred to as “the Purchaser”, intends using part of the proceeds of a loan from the Bank towards the cost of Yavan Solid Waste Project.
3) The Purchaser now invites sealed tenders from Suppliers for the following Contract[s] to be funded from part of the proceeds of the loan:
— Lot 1. Specialized Vehicles for Landfill,
— Lot 2. Waste Collection Trucks and Water Tanker.
Tenders are invited for one or more lots. Each lot must be priced separately. Tenders for more than one lot may offer discounts and such discounts will be considered in the comparison of tenders. The Goods delivery period is 17 weeks from the Effectiveness Date of the Contract with the Related Services to be subsequently completed within 2 weeks. The lots must be executed concurrently.
4) Tendering for contracts to be financed with the proceeds of a loan from the Bank is open to firms from any country.
5) To be qualified for the award of a Contract, Tenderers must substantially satisfy at least the following minimum criteria:
(a) Financial resources requirement.
The Tenderer must demonstrate access to, or availability of, financial resources such as liquid assets, unencumbered real assets, lines of credit, and other financial means, other than any contractual advance payments to meet the cash-flow requirement in the amount of 100 % of their tender price and that these funds are free from its current commitments. Alternatively, if the financing is provided by the manufacturer via the delayed payments arrangements made available to the Supplier then this shall be confirmed in the Manufacture Authorization Form with the specification of the terms for such arrangement. If there is any gap in the financing needs, the tenderer shall demonstrate how this is going to be covered.
The lead partner of a JVCA shall meet 70 % of this requirement. Each other partner shall meet not less than 30 % of this requirement.
(b) Experience.
Experience as Supplier, in at least 2 (two) contracts within the last 5 (five) years, each with a value of at least
Lot 1: 150 000 USD
Lot 2: 500 000 USD
That have been successfully and substantially completed and that are similar to the proposed Goods. The similarity shall be based on the nature and complexity of the Goods compared with the Goods described in Section V: Supply Requirements;
The lead partner of a JVCA shall demonstrate successful experience in at least one contract of similar nature and magnitude.
(c) Historical Contract Non-Performance.
The Tenderer, or any partner in a JVCA, shall not have a consistent history of litigation and/or arbitration resulting in awards against the Tenderer, or any partner in a JVCA, within the last 3 (three) years, namely 2015-2017.
This determination shall be based solely on fully settled disputes or litigation. A fully settled dispute or litigation is one that has been resolved in accordance with the Dispute Resolution Mechanism under the respective Contract, and where all appeal instances available to the Tenderer have been exhausted.
All pending litigation shall in total not represent more than twenty percent (20 %) of the Tenderer’s net worth and shall be treated as resolved against the Tenderer.
6) The tender documents are available electronically on a free of charge basis.
7) Tenders must be delivered to the office at the address below on or before 15:30 local Dushanbe time on 29 October 2018, at which time they will be opened in the presence of those Tenderers’ representatives who choose to attend.
