6.Nature of contractFee-based contract.
7.Contract descriptionThe project will consist of technical assistance to the Peruvian institutions responsible for implementing the National Anti-Drug Strategy and related policies. The missions
of the experts will be defined on the basis of the needs of the beneficiary institutions. The main expert (and Team Leader) will be in charge of the daily management of the technical assistance
and of identifying, in collaboration with the competent Peruvian authorities, the bottlenecks, needs and the kind of solutions required.
8.Lot number and lot titleOnly 1 lot.
9.Maximum budget1 700 000 EUR
10.Scope of additional servicesThe Contracting Authority, should it deem it necessary, may extend the duration or scope of the project, subject to the availability of funding, up to an estimated
value of approximately 1 700 000 EUR. Any extension of the contract will be subject to satisfactory performance by the contractor.
11.EligibilityParticipation is open to all natural persons who are nationals and all legal persons (participating individually or grouped together in a tenderers" consortium) effectively
established in a Member State of the European Union or in an eligible country or territory as defined in Regulation (EU) No 236/2014 of the European Parliament and of the Council of 11 March
2014 laying down common rules and procedures for the implementation of the Union"s instruments for financing external action, applicable for the instrument under which the contract is financed
(see also point 29 below). Participation is also open to international organisations.For the attention of candidates and tenderers in the United Kingdom: Please be aware that after the United
Kingdom"s withdrawal from the EU, the rules of access to EU procurement procedures of economic operators established in third countries will apply to candidates or tenderers from the United
Kingdom depending on the outcome of the negotiations. If the regulatory provisions in force do not provide for such access, UK candidates and tenderers may be excluded from the public procurement
procedure.
12.CandidatureAny eligible natural or legal person (as defined in point 11 above) or grouping of such persons (consortium) may take part in the tender.A consortium can be a permanent grouping
with a legal status or an informal grouping created for a particular invitation to tender. All the members of a consortium (i.e. the lead tenderer and all other partners) are to be jointly and
severally liable vis-à-vis the contracting authority.The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person.
Furthermore, if that ineligible person belongs to a consortium, the whole consortium will be excluded.
13.Number of applicationsNatural and legal persons can only submit 1 application, irrespective of the form their participation may take (as an individual legal entity or lead tenderer or partner
in a consortium submitting an application). Should a natural or legal person submit more than 1 application, all applications involving the said person will be rejected.
14.Shortlist alliances prohibitedAny tenders received from tenderers which include firms not mentioned on the shortlisted application forms will be excluded from this restricted tender procedure,
unless prior approval from the Contracting Authority has been obtained (see Section 2.6.3 of the Practical Guide). Shortlisted candidates may not form alliances or subcontract to each other for
this contract.
15.Grounds for exclusionAs part of the application form, candidates must submit a signed declaration, included in the standard application form, confirming that they are not in any of the
exclusion situations listed in Section 2.6.10.1 of the Practical Guide.Candidates included in the lists of EU restrictive measures (see Section 2.4 of the Practical Guide) at the moment of the
award decision cannot be awarded the contract.
16.SubcontractingSubcontracting is allowed.
17.Number of candidates to be shortlistedBased on the applications received, between 4 and 8 candidates will be invited to submit detailed tenders for this contract. Should the number of
eligible candidates meeting the selection criteria be less than the minimum of 4, the contracting authority may invite those candidates meeting the said criteria to submit a tender.

21.Selection criteriaThe following selection criteria will apply to tenderers. Where applications are from a consortium, these criteria will apply to the consortium as a whole, unless stated
otherwise. The selection criteria will apply neither to natural persons nor single-member companies working as subcontractors.(1) Candidate"s economic and financial capacity (based on section 3
of the application form). Where the tenderer is a public body, equivalent information must be provided. The reference period that will be taken into account will be the last 3 financial years
for which closed accounts are available.Criteria for natural and legal persons:1. The candidate"s average annual turnover for the last 3 years (2018, 2017 and 2016) must exceed 650 000 EUR;2.
The current ratio (current assets/current liabilities) for the last year for which closed accounts are available must be at least 1. In the case of a consortium, each member must comply with
this criterion;(2) Candidate"s professional capacity (based on sections 4 and 5 of the application form). The reference period that will be taken into account will be the last 3 years prior to
the submission deadline.Criteria for natural and legal persons:1. At least 5 employees must have worked each year, in 2018, 2017 and 2016, for the candidate in fields related to this contract
(law enforcement, justice, security, fight against drugs, alternative development);(3) Candidate"s technical capacity (based on sections 5 and 6 of the application form). The reference period
that will be taken into account will be the last 3 years prior to the submission deadline.Criteria for natural and legal persons:1. In the past 3 years, the candidate has been executing/has
successfully executed at least 2 contracts with a budget at least equal to the one of this contract and in fields related to this one (law enforcement, justice, security, fight against drugs,
alternative development);2. In the past 3 years, the candidate has satisfactorily completed (approved final report) at least 1 technical assistance contract with the main task of providing
support to a government by identifying needs and managing experts.Prior experience that resulted in a breach of contract and termination thereof by the contracting authority cannot be used as a
reference.An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has therewith.
In such an event, it must provide the contracting authority with evidence that it has the resources needed for contract performance, for example, by obtaining a commitment from said entities to
place such resources at its disposal. Such entities, for instance the parent company of the economic operator, must respect the same rules oneligibility, particularly those regarding nationality,
and fulfil the same selection criteria as the economic operator. With regard to the technical and professional criteria, economic operators may rely on the capacities ofother entities only if the
latter will carry out the works or provide the services for which these capacities are necessary. With regard to the economic and financial criteria, the entities on whose capacities the tenderer
will rely shall become jointly and severally liablefor contract execution.Should more than 8 candidates prove to be eligible, i.e. meet all the aforementioned selection criteria, the respective
strengths and weaknesses of their applications will be re-examined in order to select the 8 most suitable candidates. The only additional comparative criteria that will be considered in the
re-examination shall be those listed below, in this order:1. The highest number of contracts meeting the requirements of criterion 1 in point 21(3);2. The highest value of contracts meeting the
requirements of criterion 1 in point 21(3).Note: Additional comparative criterion 2 will be applied only if the number of eligible candidates remains higher than 8 after applying additional
comparative criterion 1.

23.Deadline for submission of applicationsAttention is drawn upon the candidate to the fact that there are 2 different systems for submitting applications: either by mail or private courier, or
delivery by hand.In the first case, the application should be sent before the date and time of the submission deadline, of which the postmark or deposit slip will serve as evidence [1], but in
the second case the acknowledgment of receipt issued at the delivery of the application will serve as evidence.The deadline for submission of applications is 26.8.2019 (16:00), local time in
Peru. Applications sent to the Contracting Authority after this deadline will not be considered.For reasons of administrative effectiveness, the Contracting Authority may reject any application
submitted on time to the postal service but received, for any reason beyond the control of the Contracting Authority, after the effective date of approval of the preselection report, if the
acceptance of these applications submitted on time, but delivered late, considerably delays the evaluation procedure or jeopardises the decisions already adopted and notified.[1] It is
recommended to use recorded delivery in case the postmark is illegible.
24.Format of the application and details to be providedApplications must be submitted using the standard application form; the instructions given in this form and its format must be strictly

25.Application submission proceduresApplications must be submitted to the contracting authority exclusively in Spanish in a sealed envelope:— Either by postal service or private courier, in

contract title and the publication reference (see point 1 above) must be clearly marked on the envelope containing the application and must always be mentioned in all subsequent correspondence
with the Contracting Authority.Applications submitted in any other way will not be considered.When submitting their applications, candidates agree to receive notification of the result of the
procedure by electronic means. The notification shall be deemed to have been received on the day the contracting authority sends it to the email address stated in the application.
26.Alteration or withdrawal of applicationsCandidates may give notice in writing, before the deadline for submission of applications, that they intend altering or withdrawing their application.
Applications may not be altered after this deadline.Any notification of alteration or withdrawal must be submitted in accordance with point 25. The word "Modificación" (alteration) or
"Retirada" (withdrawal), as applicable, must be written clearly on the outside envelope (and on the corresponding inside envelope).
27.Operational languageAll correspondence concerning this invitation to tender procedure and contract must be in Spanish.
