7.Contract descriptionThe technical assistance contract entails supporting and strengthening the regulatory and institutional framework for a sustainable livestock production and its diversification, with lines of action aimed at reinforcing the institutional capacities of the public sector and providing the private sector with national sectoral policies, legislation and services favourable for its development, including matters related to sustainable livestock production in policies and national legislation.Furthermore, it must include the reinforcement of the sanitary framework for non-traditional livestock sectors (cow milk, poultry and its by-products, pork, sheep, goats, aquaculture, apiculture), with lines of action aimed at strengthening or broadening the scope of the national quality and sanitary infrastructure for these livestock sectors, including its capacity for control implementation and traceability.

9.Maximum budgetEUR 2 500 000

10.Scope of additional servicesThe contracting authority, should it deem it necessary, may extend the project"s duration or scope, subject to the availability of funding, up to the estimated value of approximately EUR 2 500 000. Any extension of the contract will be subject to satisfactory performance by the contractor.

11.EligibilityParticipation is open to natural and legal persons (individually or grouped together in a tenderers" consortium) established in a Member State of the European Union or in an eligible country or territory as defined in Regulation (EU) No 236/2014 laying down common rules and procedures for the implementation of the Union"s instruments for financing external action (REC) for the instrument applicable to the programme under which the eligible contract is financed (see also point 29 below).International organisations may also take part.

12.CandidatureNatural persons or legal entities who are eligible (see point 11 above) or groupings of said parties (consortia) may take part in the invitation to tender.A consortium can be a permanent grouping with a legal status or an informal grouping created for a particular invitation to tender. All the members of a consortium (i.e. the lead tenderer and all other partners) are to be jointly and severally liable vis-à-vis the contracting authority.The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person.Furthermore, should said party belong to a consortium, the whole consortium will be excluded.

13.Number of applicationsNatural persons and legal entities can only submit 1 application, irrespective of the form their participation may take (as the sole legal entity or lead tenderer or partner in a consortium submitting an application). Should a natural person or legal entity submit more than 1 application, all applications involving the said party will be rejected.

14.Shortlist alliances prohibitedAny tenders received from tenderers which include firms not mentioned on the shortlisted application forms will be excluded from this restricted tender procedure, unless prior approval from the contracting authority has been obtained (see the Practical Guide — PRAG 2.4.3).Shortlisted candidates may not form alliances or subcontract to each other for this contract.

15.Grounds for exclusionAs part of the application form, candidates must submit a signed declaration, included in the standard application form, confirming that they are not in any of the exclusion situations listed in section 2.3.3 of the Practical Guide.

16.Sub-contractingSubcontracting is allowed.

17.Number of candidates to be shortlistedBetween 4 and 8 candidates will be invited to submit detailed tenders for this contract, depending on the applications received.Should the number of eligible candidates meeting the selection criteria be less than the minimum of 4, the contracting authority may invite those candidates meeting the said criteria to submit a tender.

18.Provisional date of invitation to tenderMay 2018.

19.Scheduled date for commencing the contractOctober 2018.

20.Initial period of implementation of tasks30 months.

21.Selection criteriaThe following selection criteria will apply to tenderers. Where applications are from a consortium, these criteria will apply to the consortium as a whole, unless stated otherwise. The selection criteria will apply neither to natural persons nor single-member companies working as subcontractors.1) Candidate"s economic and financial capacity (based on section 3 of the application form). Where the tenderer is a public body, equivalent information must be provided. The reference period that is taken into account will be the last 3 financial years for which closed accounts are available.Criteria for legal and natural persons:1. The tenderer’s average annual turnover must exceed EUR 1 000 000; and2. The solvency ratio (current assets/current liabilities) for the past year for which closed accounts are available must be at least 1. In the case of a consortium, each member must comply with this criterion.2) Candidate"s professional capacity (based on sections 4 and 5 of the application form). The reference period that is taken into account will be the 3 years prior to the submission deadline.Criteria for natural persons and legal entities:1. At least 3 members of staff must have worked for the tenderer in fields related to this contract in each year of the reference period (in 2016, 2017 and 2018).3) Candidate"s technical capacity (based on sections 5 and 6 of the application form). The reference period that is taken into account will be the 5 years prior to the submission deadline.Criteria for legal entities and natural persons:1. The candidate has provided services under at least 1 contract with a budget of at least EUR 2 500 000, which was implemented at some point during the reference period: 1 January 2013 through 31 December 2017 and which covers at least one (1) of the following fields:— Institutional development and strategic planning in the agricultural public sector,— Sustainable Livestock Production,— Climate Change mitigation and adaptation for the Livestock sector,— Institutional strengthening of official labs for quality, health and animal welfare.This means that the project to which the candidate refers could have been started or completed at any time during the given period, but it does not necessarily have to be started or completed during that period, nor implemented during the entire period. Candidates or tenderers may refer to projects completed within the reference period (even though they may have begun earlier) or projects which are still ongoing.In the first case, the project will be viewed as a whole should proof of service provision be provided (declaration or certificate from the entity which awarded the contract, proof of final payment). In the event of ongoing projects, only the part which has been satisfactorily completed during the reference period will be taken into consideration (even if they had begun earlier). This part must be supported by documentary evidence (in a similar manner to the completed projects), with details of its value. Should a candidate or tenderer have undertaken the project as part of a consortium, the percentage that the candidate or tenderer successfully performed must be clearly stated in the documentary evidence, together with a description of the nature of the services provided, where the selection criteria with respect to relevance of practical experience were used.Prior experience involving a breach of contract and termination thereof by the contracting authority cannot be used as a reference.An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has therewith. In such an event, it must provide the contracting authority with evidence that it has the resources needed for contract performance, for example, by submitting an agreement from such entities to place said resources at its disposal. Such entities, e.g. the parent company of the economic operator, must respect the same eligibility rules — particularly those regarding nationality — and fulfil the same selection criteria as the economic operator. With regard to the technical and professional criteria, economic operators may rely on the capacities of other entities should the latter undertake the works or provide the services for which these capacities are necessary. With regard to the economic and financial criteria, the entities on whose capacities the tenderer will rely shall become jointly and severally liable for contract performance.Should more than 8 candidates prove to be eligible, i.e. meet all the aforementioned selection criteria, the respective strengths and weaknesses of their applications will be re-examined in order to select the 8 most suitable candidates. Only the following factors will be considered in this re-examination:i. The most contracts meeting criterion 21.3.1.ii. The highest cumulative value of the projects meeting criterion 21.3.1.NB: Point i. will be applied first.Point ii. will only be applied in the event of a tie between candidates in point i.

22.Award criteriaBest price-quality ratio.

23.Deadline for submission of applications13.00 (local time in the Republic of Paraguay) of 11 April 2018.Applications received by the contracting authority after this deadline will not be considered.

24.Format of the application form and details to be providedApplications must be submitted using the standard application form; the instructions given in this form and its format must be strictly adhered to. 25.Application submission proceduresApplications must be submitted exclusively to the contracting authority in Spanish in a sealed envelope:— either by registered post (official postal service) to: Ministerio de Agricultura y Ganadería de la República del Paraguay, Mesa de Entrada de la Dirección de Contrataciones, piso 11º, edificio San Rafael, Yegros 437, c/ Cerró Corá, Asunción. Telephone: 021 440306.In this case, the delivery register will attest to compliance with the deadline for receipt.— or delivered by hand (including courier service) directly to the contracting authority, in return for a signed and dated acknowledgement of receipt, at the following address:Ministerio de Agricultura y Ganadería de la República del Paraguay Mesa de Entrada de la Dirección de Contrataciones, piso 11º, edificio San Rafael, Yegros 437, c/ Cerró Corá, Asunción. Opening hours: 07.00 hours.In this case, the acknowledgement of receipt will attest to compliance with the deadline for receipt.The envelope containing the application must be clearly marked with the contract title and the publication reference (see point 1 above). These must also be quoted in all subsequent correspondence with the contracting authority. Applications submitted in any other way will not be considered. When submitting their proposals, candidates agree to receive notification of the result of the procedure by electronic means. The notification shall be deemed to have been received on the day the contracting authority sends it to the email address stated in the application.

26.Amendments to, or withdrawal of, applicationsCandidates may give notice in writing before the deadline for submission of applications that they intend amending or withdrawing their application. Applications may not be amended after this deadline. Any notification of amendment or withdrawal must be submitted in accordance with point 25. The word "Modificación" (amendment) or "Retirada" (withdrawal), as applicable, must be clearly written on the outside envelope (and on the corresponding inside envelope).

27.Operational languageAll correspondence concerning this invitation to tender procedure and contract must be in: Spanish.

29.Legal basisRegulation (EU) No 236/2014 of the European Parliament and of the Council of 11.3.2014 laying down common rules and procedures for the implementation of the Union"s instruments for financing external action, and Regulation (EC) No 1905/2006 of the European Parliament and of the Council of 18.12.2006 establishing a financing instrument for development cooperation; see Annex A2 to the Practical Guide.To the attention of candidates and tenderers in the United Kingdom: Please be aware that after the United Kingdom"s withdrawal from the EU, the rules of access to EU procurement procedures of economic operators established in third countries will apply to candidates or tenderers from the United Kingdom depending on the outcome of the negotiations.
