Profiling Rights for the Cycle Race Arctic Race of Norway
The Arctic Race of Norway is an annual international stage race on road bikes, which is held in Nordland, Troms and Finnmark counties. The race has been held 6 times before and it is already the largest of its kind in the Nordic countries. In 2018 the race had an estimated TV value of 270 000 000 NOK through 1 380 hours with TV pictures broadcast in 190 counties. The event works across geographical, political and social dividing lines and represents values and visions that Nordland, Troms and Finnmark counties (the counties) would like to identify with.
The procurement concerns the purchase of profiling rights from ARN. The aim of the purchase is to secure profiling of the counties in Norway and abroad and in a way where the county municipalities are identified with the Arctic Race of Norway event.

The rights to the Arctic Race of Norway are owned by the company Arctic Race of Norway AS (ARN). The procurement concerns the purchase of profiling rights from ARN. The aim of the purchase is to secure profiling of the counties in Norway and abroad, in a way where the counties are identified with the Arctic Race of Norway event:
— profiling — individual and combined profiling of the counties.
Nordland, Troms and Finnmark counties procure profiling of each county as well as joint profiling of the 3 counties in North Norway.
— showing:
The rights cover separate areas at the start, on the course and at the finish line, as well as the counties’ graphical characteristics must be presented in different ways. The counties is also given a right to procure advertisement space on the Arctic Race of Norway"s official website, in addition to the counties having the right to use TV clips for their own marketing purposes.
— influencing possibilities:
The counties are given the right to actively participate in the planning and implementation of the cycle race and thereby maximise the usefulness of the rights that the counties have been granted. In order to ensure the broadest possible exposure of the counties, the race shall be held in different regions.
— other rights:
The rights include the use of ARN"s media platform, the right to participate in forums and seminars, the right to participate in facilitating and activities for the press and media, as well as the right to participate in ARN"s other programmes.
The contract will be valid from the date it is signed until 31.12.2021. It then runs for a further one year until 31.12.2022 unless one of the parties terminates the contract or requests renegotiation by 1.6.2021.

Section IV: Procedure
The counties are responsible for the regional development in the counties, which covers promoting and making the counties visible in Norway and abroad in order to stimulate local activity. Such promotion can occur through a regional event that both reflects the values that the counties would like to identify with and which secures broad exposure of different areas in the region. Based on the Arctic Race of Norway"s size, implementation, values and broad international participation, the counties see the event as a unique platform for promotion. There are no other events of an equivalent size and with an equivalent length that are arranged in the region, and which at the same time reach as many people in Norway and abroad. Based on a general and judgemental assessment of the event"s nature, implementation and values, the counties sees the cycle race as an event that the counties can identify with and which, therefore, is an appropriate means for showing off the counties. The counties thus believe that there are no other actual suppliers of equivalent services in the EEA area. The assessment of to what extent and how the counties can achieve the desired promotion through events is very judgemental. The decisive factor is a combination of the event"s power of penetration and whether the event"s nature and value basis makes it attractive for the counties to identify with this. As the counties see it, these assessments are so judgemental that under no circumstances will it be possible to announce a competition based on sufficiently clear and precise award criteria. The counties therefore believe that the procurement regulations § 13-4 letter b provides a legal basis to implement the procurement without a prior notice. The counties intend to sign a contract with ARN if there are no objections within the appeals deadline.
