7.Contract descriptionThe contractor shall provide technical assistance services to the SIECA – INTEC Project through the provision of experts, preparation of materials and documents as well as holding of events (including their logistics) in the 6 countriesof the Central American region. The activities to be performed, being the object of this contract, include, but are not limited to:— Designing and teaching a high-level regional certificate (virtual course) in customs,— supporting the companies in the region with trade mark registration,— providing support to the companies in the region with collective trade mark registration,— developing capacities and training in the region on the “Enforcement” of Intellectual Property rights and illegal trade in the framework of Trade Facilitation,— holding a regional discussion and awareness-raising forum on the importance of the relationship between the competition policy and Economic Integration,— designing and implementing an Awareness-Raising Program, through a regional forum and dissemination materials focused on Competition Policy Promotion,— updating the “Central American Customs Union Roadmap (2014-2024)”,— conducting a study on the merchandise contained in Annex A of the General Treaty of Central American Economic Integration,— conducting a study and making a proposal on the regulations applicable to the commercial exchange of the merchandise produced in special customs regimes in the region and their possible revision in view of the WTO agreements and the Integration legal instruments,— conducting an impact study on implementation in the region of the measures of the Trade Facilitation Agreement of the World Trade Organisation,— supporting the implementation of measures 1, 2 and 3 regarding: advance declaration of merchandise, streamlining and coordination of immigration controls and electronic phytosanitary and zoosanitary certificates, in the framework of the Central American Strategy for Trade Facilitationand Competitiveness.

10.Scope of additional servicesThe Contracting Authority, should it deem it necessary, may extend the project"s duration or scope, subject to the availability of funding. Any extension of the contract will be subject to satisfactory performance by the contractor.

11.EligibilityParticipation is open to all natural persons who are nationals and all legal persons (participating individually or grouped together in a tenderers" consortium) effectively established in a Member State of the European Union or in an eligible country or territory as defined in Regulation (EU) No 236/2014 of the European Parliament and of the Council of 11.3.2014 laying down common rules and procedures for the implementation of the Union"s instruments for financing external action, applicable for the instrument under which the contract is financed (see also point 29 below).Participation is also open to international organisations.

12.CandidatureAny eligible natural or legal person (as defined in point 11 above) or grouping of such persons (consortium) may take part in the tender.A consortium can be a permanent grouping with a legal status or an informal grouping created for a particular invitation to tender. All the members of a consortium (i.e. the lead tenderer and all other partners) are to be jointly and severally liable vis-à-vis the contracting authority.The participation of an ineligible natural or legal person (as per item 11) will result in the automatic exclusion of that person. Furthermore, should said party belong to a consortium, the whole consortium will be excluded.

13.Number of applicationsNatural and legal persons can only submit 1 application, irrespective of the form their participation may take (as an individual legal entity or lead tenderer or partner in a consortium submitting an application).Should a natural or legal person submit more than 1 application, all applications involving the said party will be rejected.

14.Shortlist alliances prohibitedAny tenders received from tenderers which include firms not mentioned on the shortlisted application forms will be excluded from this restricted tender procedure, unless prior approval from the contracting authority has been obtained (see the Practical Guide — PRAG 2.4.3). Shortlisted candidates may not form alliances or subcontract to each other for this contract.

15.Grounds for exclusionAs part of the application form, candidates must submit a signed declaration, included in the standard application form, confirming that they are not in any of the exclusion situations listed in section 2.3.3 of the Practical Guide.

16.SubcontractingSubcontracting is allowed.

17.Number of candidates to be shortlistedBetween 4 and 8 candidates will be invited to submit detailed tenders for this contract, depending on the applications received.Should the number of eligible candidates meeting the selection criteria be less than the minimum of 4, the contracting authority may invite those candidates meeting the said criteria to submit a tender.

21.Selection criteriaThe following selection criteria will apply to tenderers. Where applications are from a consortium, these criteria will apply to the consortium as a whole, unless stated otherwise. The selection criteria will apply neither to natural persons nor single-member companies working as subcontractors.(1) Candidate"s economic and financial capacity (based on section 3 of the application form). Where the tenderer is a public body, equivalent information must be provided. The reference period that is taken into account will be the last 3 financial years for which closed accounts are available.Criteria for natural and legal persons:(a) The candidate"s average annual turnover must be at least 1,5 times the annualised maximum budget of the contract, i.e. the maximum budget stated in the contract notice divided by the initial contract duration in years, where this exceeds 1 year; and(b) The current ratio (current assets/current liabilities) for the last year for which closed accounts are available must be at least 1. In the case of a consortium, all of its members must fulfil this criterion;(2) Candidate"s professional capacity (based on sections 4 and 5 of the application form). The reference period that is taken into account will be the last 3 years prior to the submission deadline.Criteria for natural and legal persons:(c) The candidate (or, in the case of a consortium, any of its members) must be specialised in the areas of regional economic integration systems, international trade or trade strengthening;(d) The candidate (or, in the case of a consortium, any of its members) must be specialised in the areas of training or education and conducting studies on international trade or regional economic integration systems;(e) In the last 3 years, at least an average of 10 % of the candidate’s staff have worked in areas related to the contract (expert management, consulting, regional economic integration systems, international trade, facilitation of trade);(3) Candidate"s technical capacity (based on sections 5 and 6 of the application form). The reference period that is taken into account will be the last 3 years prior to the submission deadline.Criteria for natural and legal persons:(f) The candidate has provided services under at least 6 contracts: 3 in the areas related to regional economic integration systems, international trade or facilitation of trade, and 3 in the area of training or conducting technical studies. At least 2 contracts must have a budget of over 400 000 EUR. The contracts were implemented at any moment during the reference period.This means that the projects to which the candidate refers could have been started or completed at any time during the given period, but they do not necessarily have to be started or completed during that period, nor implemented during the entire period. Candidates or tenderers may refer to projects completed within the reference period (even though they may have begun earlier) or projects which are still ongoing. In the first case, the project will be viewed as a whole should proof of service provision be provided (declaration or certificate from the entity which awarded the contract, proof of final payment).In the event of ongoing projects, only the part which has been satisfactorily completed during the reference period will be taken into consideration (even if they had begun earlier). This part should be backed by documentary evidence (similar to the completed projects) on which its amount is shown (this amount should be reflected on the tender submission form).Should a candidate or tenderer have undertaken the project as part of a consortium, the percentage that the candidate or tenderer successfully performed must be clearly stated in the documentary evidence, together with a description of the nature of the services provided, where the selection criteria with respect to relevance of practical experience were used.Prior experience involving a breach of contract and termination thereof by the contracting authority cannot be used as a reference.An economic operator may, where appropriate and for a particular contract, rely on the capacities of other entities, regardless of the legal nature of the links which it has therewith.In such an event, it must provide the contracting authority with evidence that it has the resources needed for the contract implementation, for example, by submitting an agreement from such entities to place said resources at its disposal. Such entities, e.g. the parent company of the economic operator, must comply with the same rules of eligibility, particularly those regarding nationality, and fulfil the same selection criteria as the economic operator.With regard to the technical and professional criteria, economic operators may rely on the capacities of other entities should the latter undertake the works or provide the services for which these capacities are necessary. With regard to the economic and financial criteria, the entities on whose capacities the tenderer will rely shall become jointly and severally liable for contract performance.Should more than 8 candidates prove to be eligible, i.e. meet all the aforementioned selection criteria, the respective strengths and weaknesses of their applications will be re-examined in order to select the 8 most suitable candidates. Only the following factors will be considered in this re-examination:(1) The most experience in Central American regional economic integration systems (the highest number of contracts under criterion 3(f) will be taken into account, considered from the point of view of regional economic integration and validated in the first phase of selection criteria compliance validation);(2) The highest total value of contracts under criterion 3(f) (validated in the first phase of selection criteria compliance validation).Note: Factor (1) shall be applied to all eligible candidates meeting the selection criteria in order to classify said candidates and identify the 8 most suitable candidates.Should the application of factor (1) result in a list including more than 8 candidates, with 2 or more of them being on equal terms to be classified as one of the 8 most suitable candidates, factor (2) shall be applied only to these last candidates to decide between them.

The notification shall be deemed to have been received on the day the contracting authority sends it to the email address stated in the application.

26.Alteration or withdrawal of applicationsCandidates may give notice in writing, before the deadline for submission of applications, that they intend altering or withdrawing their application. Applications may not be amended after this deadline.Any notification of amendment or withdrawal must be submitted in accordance with point 25. The word "Modificación" (amendment) or "Retirada" (withdrawal), as applicable, must be written clearly on the outside envelope (and on the corresponding inside envelope).
