Detailed description of the subject of the public procurement contract shall be enclosed in the technical specifications and the Bill of Quantites, an integral part of the public procurement documentation.
The selected most favourable Bidder should provide a Good Performance Warranty in amount of 10 % of the contract value (VAT included).
The warranty shall be submitted in the form of a bank warranty in writing. The warranty should be submitted in original form. Copies shall not be accepted.
The Good Performance Warranty shall be valid until full completion of the contract. The Contracting Authority, having selected the most favourable Bidder, shall additionally establish the validity period of the guarantee.
The Bank guarantee for the Good Performance Warranty shall be expressed in MKD.
The Good Performance Waranty must be issued by a bank.
The most favourable Bidder shall submit the Good Pperformance Waranty within 5 /five/ days of signing the contract.
The Good Performance Waranty shall be submitted within the envisaged period, as follows: by mail or in person to the contact person mentioned in the public procurement documentation.
The payment under the Good Performance Waranty shall be collected if the Main Contractor fails to meet any of the obligations of the public procurement contract within the maturity date, informing the Main Contractor in writing regarding the same. If the payment is collected under the Good Performance Waranty, the Contracting Authority shall announce a negative eference to the ESPP. The Main Contractor may initiate proceedings in front of a competent court for payment of the bank guarantee for contract quality performance.
If the public procurement contract has been fully carried out in accordance with what has been agreed, the bank guarantee - the Good Performance Waranty shall be returned by the Contracting Authority to the Main Contractor within 14 days of the full contract implementation.
The good performance guarantee shall be returned by the Main Contractor by mail, in person at the economic operator’s business seat or in person at the Contracting Authority’s business seat.
The payment shall be made on the basis of monthly interim situations for completed works and submission of construction book certified by the supervising engineer, certified by the supervisory authority and the orderer of the works within 20 days.
The terms of payment are mandatory. Each Bid that contains terms of payment different from the ones specified in this section shall be deemed unacceptable and shall be rejected by the Public Procurement Committee.
For the purpose of proving its personal status, the economic operator shall submit the following documents:
— statement by the economic operator that no effective court decision for participation in criminal organization, corruption, fraud or money laundering was rendered in the past 5 years,
— statement by the competent authority that no bankruptcy procedure has commenced,
— statement by the competent authority that no liquidation procedure has commenced,
— receipt on settled taxes, contributions and other public duties by the competent authority from the country of registration of the economic operator,
— statement from the Register of penalties for crimes committed by legal entities stating that no minor penalty – temporary or permanent ban has been pronounced for participation in invitation to public procurement procedures, procedures for awarding public procurement contracts or private-public partnership contract,
— statement from the Register of penalties for crimes committed by legal persons stating that no minor penalty – temporary or permanent interdiction on carrying out particular business activity has been pronounced
— statement that no misdemeanour sanction – interdiction on carrying out/exercising profession, activity or responsibility, i.e. temporary interdiction on carrying out particular business activity, has been pronounced with an effective court decision.
In order to prove its capacity to pursue a professional activity, the economic operator shall submit:
— a document of registered business activity as a proof that it has been registered as physical or legal entity for exercising the business activity related to the subject of the public procurement contract or a proof that it belongs to a respective professional association pursuant to the regulations in the country of its registration,
— Licence A* for construction of first category buildings issued by the Ministry of Transport and Communications.
*In the Republic of Macedonia, a foreign legal entity may perform works of designing, review, construction and supervision prescribed in this Law, if they obtain confirmation for performing the above works by the authorized body of the state administration responsible for carrying out activities in the field of spatial organization. www.mtc.gov.mk
In order to qualify as capable to execute the subject of the public procurement contract in terms of its technical or professional capacity, the economic operator shall fulfill the following minimum conditions:
— In the last 5 years, the economic operator should have realised at least two contracts on construction, with each of the contracts valued no less than the denar equivalent of 800 000 EUR (without value-added tax),
— To have/to own the technical equipment and the construction works mechanization for demolition, building and production of prefabricated montage reinforced concrete panels.
Minimum level(s) of standards possibly required:The economic operator shall the fulfillment of the technical or professional capacity, by submitting the following:
— List of realized construction contracts in the last 5 years, with each contract’s value no less than the denar equivalent of 800 000 EUR (without value-added tax), containing description and contract number, investor’s name, time and date of realization and the contract value (reference list),
— At least two confirmation documents issued by investors for a properly, timely and quality construction realization, for realized contracts listed in the list (reference list), with each contract’s value no less than the denar equivalent of 800 000 EUR (without value-added tax),
— List of the members of a professional team who will be employed for the realization of the purchase consisting of:
1) Construction manager with an architecture or civil engineering diploma with an Authorization A license for construction, 1 person;
2) A civil engineer with an Authorization A license for construction, 1 person;
3) Electrical engineer with an Authorization A license for construction, 1 person;
— Authorization A license for construction for professional who will be employed for the purchase realization or other appropriate proof if the bidder is from abroad,
— CV of each of the members of the professional team who will be employed during the realization of the procurement,
— List of the minimum amount of needed equipment for demolition, building and production of prefabricated montage reinforced concrete panels
— A statement from the economic operator, i.e. the authorized person of the economic operator that he owns or rents technical equipment and mechanization for demolition, building and production of prefabricated montage reinforced concrete panels,
— A statement from the economic operator, i.e. the authorized person of the economic operator that he has his own laboratory or a statement that he will cooperate with an authorized laboratory for the examination of the quality of the built-in materials,
— If subcontractors are hired, Notification from the economic operator, i.e. the authorized person of the economic operator for the elements of the contract which the economic operator intends to assign to subcontractors, as well as data about all proposed subcontractors (firm, business address, tax number etc.).
The Contracting Authority shall use electronic auction as the final phase of the open procedure. The subject of the e-auction is the overall price including all costs and discounts and import duties, VAT excluded. The initial price in the electronic auction is the lowest price of all Acceptable bids proposed in the initial phase of the procedure.
The invitations for participation in the auction shall be distributed electronically through the ESPP, following a full evaluation of initial bids, to all economic operators that have submitted acceptable bids in the first phase of the procedure and are registered in the ESPP.
The invitation to participate in the auction shall be sent electronically to the user’s profile e-mail address at the ESPP, to the person which shall submit bid for the appropriate procedure using electronic means.

Persons authorised to be present at the opening of tenders: yesEvery stakeholder holds the right to be present at the public opening of Bids.
Only the authorized representatives of the Bidders may participate in the procedure of public opening of bids by presenting their comments in the Minutes of Bid opening.
At the public opening, the authorized representatives of the economic operators must present an authorization signed by the responsible person of the economic operator. All authorized representatives of the economic operators present at the public opening should sign a List of participants
This procedure shall be conducted via electronic means of the Electronic System for Public Procurement (ESPP) (https://www.e-nabavki.gov.mk).
Additional information regarding the use of electronic means: In order to be able to participate in the electronic auction, it is required to register at the ESPP and to provide a digital certificate. The economic operator shall register at the ESPP by filing the registration form which makes an integral part of the ESPP, after which, the ESPP shall automatically process the data from the registration form, and after the system shall generate a code and submit the said code to the registered electronic mail of the economic operator. Additional information regarding the method of registration and use of the system may be obtained at the ESPP “User manual for Economic Operators”, which can be downloaded from the home page of the ESPP website under the section “Economic Operators”.
