6.Description of the contractThe contract aims to provide the Ministry of Industry and Mines (Algeria) with:1) computer equipment for its information system (Data Centre);2) 3 laboratories of the
Mechanics Technical Centre (Centre technique de la mécanique - CTIME) with control, testing and metrology equipment:— non-destructive testing laboratory,— mechanical testing laboratory,—
dimensional metrology laboratory.The contract includes the installation and commissioning of equipment.
7.Number and titles of lotsThis contract is made up of 4 lots:— lot 1: IT equipment and software solutions for the MIM Data Centre,— lot 2: non-destructive testing laboratory of (CTIME),—
lot 3: mechanical testing laboratory of (CTIME),— lot 4: dimensional metrology laboratory of (CTIME).
8.Eligibility and rules of originParticipation in the contract is open to all natural persons who are nationals of one of the Member States of the European Union or of one of the eligible
countries or territories, as defined in Regulation (EU) No 236/2014 laying down common implementing rules and procedures (CIR) of the Union’s instruments for financing external action, for the
instrument applicable to the aid programme under which the contract is financed, and to all legal entities (whether they participate individually or as part of a grouping (consortium) of
tenderers) that are actually established in one of these States, countries or territories (see also point 22 below).All supplies purchased under this contract must come from one or more of these
countries.Please note that, after the United Kingdom"s withdrawal from the EU, the rules of access to EU procurement procedures for economic operators established in third countries and for any
goods originating from third countries will apply to candidates or tenderers from the United Kingdom, and to all candidates or tenderers proposing goods originating from the United Kingdom,
depending on the outcome of negotiations. If such access is not provided for by thelegal provisions in force at the time of awarding the contract, candidates and tenderers from the United
Kingdom, and candidates and tenderers proposing goods originating in the United Kingdom, may be excluded from the procurement procedure.
9.Grounds for exclusionTenderers must submit a signed declaration (included in the tender form for a supply contract) certifying that they are not in any of the situations referred to in section
2.6.10.1. of the Practical Guide to Contract Procedures for EU External Action (PRAG).Tenderers included in the lists of persons, groups and entities subject to EU restrictive measures (see
Section 2.4. of the PRAG) at the moment of the award decision cannot be awarded the contract.
10.Number of tendersCandidates may submit an application for one lot only, for several lots, or for all of the lots, but may only submit one application per lot. Tenders for parts of a lot will
not be considered. Tenderers are not authorised to submit a variant tender in addition to their tender for the supplies required in the invitation to tender dossier.Contracts will be awarded lot
by lot, and each lot will be the subject of a separate contract. Tenderers may state in their tender whether they would grant a discount should they be awarded several lots.
11.Tender guaranteeTenderers must provide a tender guarantee of 6 000 EUR for lot 1; 6 280,32 EUR for lot 2; 14 021,92 EUR for lot 3 and 29 042,54 EUR for lot 4 when submitting their tender. This
guarantee will be returned to unsuccessful tenderers once the invitation to tender procedure has been completed and to the successful tenderer(s) once the contract has been signed by all parties.
This will be drawn on if the tenderer does not honour all the obligations stipulated in its tender.
12.Performance bondThe successful tenderer will be required to provide a performance bond for 10% of the contract amount when the contract is signed. The tenderer will have a maximum 30 days from
the date on which they receive the contract signed by the contracting authority in which to provide the bond along with the countersigned contract. Should the successful tenderer not provide the
required bond within the time allowed, the contract will be rendered null and void, and a new contract may then be drawn up and sent to the tenderer who submitted the compliant tender with the
next lowest price.
13.Information meeting and/or site visitNo information meeting is planned.
14.Validity of the tenderTenders must remain valid for 90 days from the final date for submission of tenders. In exceptional circumstances, and before the validity period expires, the contracting
authority may request tenderers to extend the validity of their tenders for a specific period (see point 8.2 of the instructions to tenderers).
15.Implementation period for the tasksEstablished at 200 calendar days, running from the signing of the contract until the provisional acceptance of the equipment.
16.Selection criteriaThe following selection criteria will be applied to tenderers. If a tender is submitted by a consortium, the selection criteria will apply to the consortium as a whole,
unless stipulated otherwise. The selection criteria will apply neither to natural persons nor single-member companies if they are participating as subcontractors.1) economic and financial
capacity of the tenderer (based on the data provided in point 3 of the tender form for a supply contract).If the tenderer is a public body, equivalent information must be provided. The reference
period to be taken into account will correspond to the past 3 financial years for which accounts have been closed.the selection criteria for each tenderer are as follows:Lot no 1: financial
criteria for legal entities:— the tenderer’s average annual turnover must exceed 600 000 EUR; and,— the ratio of short-term assets to short-term liabilities must be at least 1 for the last
financial year for which accounts have been closed. In the case of a consortium, each of its members must comply with this criterion.Financial criteria for natural persons:— the available
financial resources of the tenderer must exceed 600 000 EUR, and,— the financial situation of the tenderer must not be negative, taking into account any debts, at the beginning and the end of
the financial year;2) tenderer"s professional capacity (based on points 4 and 5 of the tender form for a supplies contract). The reference period will correspond to the past 3 financial years for
which accounts have been closed.Professional criteria for legal entities:— at least 5 of the tenderer"s staff must be currently working in fields related to this contract,— provide proof of
an appropriate professional certification for this contract, such as:—— an accreditation of representativity,—— certification.Professional criteria for natural persons:— have worked for
the past 3 years as a manager / team leader in fields related to this contract,— provide proof of an appropriate professional certification for this contract, such as:—— an accreditation of
representativity,—— certification;3) tenderer"s technical capacity (based on points 5 and 6 of the tender form for a supplies contract). The reference period will correspond to the past 3
financial years for which accounts have been closed.Technical criteria for legal entities and natural persons:— the tenderer must have delivered supplies for at least 2 contracts with a budget
of at least 1 000 000 EUR in the field of data centre computer equipment (lot 1) which were carried out during the 3 years prior to the date of submission of tenders,— the tenderer must provide
certificates of good performance of similar contracts for each lot of this contract; this means that the project to which the tenderer refers may have been started or completed at any time during
the period indicated. However, it must not necessarily have been started and completed during this period, nor implemented throughout the period concerned. Tenderers may refer either to projects
finalised during the reference period (although started before that period) or to projects that are not yet completed. In the first case, the project will be considered in its entirety provided
that sufficient proof of good performance is provided (statement or attestation from the entity that awarded the contract, final acceptance). In the case of projects still beingexecuted, only the
part that has been completed during the reference period will be taken into account. The satisfactory completion of this part must be substantiated by supporting documents (as for completed
projects), with an indication of the corresponding amount.Lot no 2: financial criteria for legal entities:— the tenderer’s average annual turnover must exceed 1 600 000 EUR, and,— the ratio
of short-term assets to short-term liabilities must be at least 1 for the last financial year for which accounts have been closed. In the case of a consortium, each of its members must comply
with this criterion.Financial criteria for natural persons:— the available financial resources of the tenderer must exceed 1 600 000 EUR and,— the financial situation of the tenderer must not

started and completed during this period, nor implemented throughout the period concerned. Tenderers may refer either to projects finalised during the reference period (although started before
that period) or to projects that are not yet completed. In the first case, the project will be considered in its entirety provided that sufficient proof of good performance is provided (statement
or attestation from the entity that awarded the contract, final acceptance). In the case of projects still being executed, only the part that has been completed during the reference period will
be taken into account. The satisfactory completion of this part must be substantiated by supporting documents (as for completed projects), with an indication of the corresponding amount.Lot no 3:

must not necessarily have been started and completed during this period, nor implemented throughout the period concerned. Tenderers may refer either to projects finalised during the reference
period (although started before that period) or to projects that are not yet completed. In the first case, the project will be considered in its entirety provided that sufficient proof of good
performance is provided (statement or attestation from the entity that awarded the contract, final acceptance). In the case of projects still being executed, only the part that has been completed
during the reference period will be taken into account. The satisfactory completion of this part must be substantiated by supporting documents (as for completed projects), with an indication of
the corresponding amount.Entities providing capacity: an economic operator may, if it considers appropriate, and for a specific contract, use the capacities of other entities, irrespective of the
legal nature of its ties to these entities. As an example, the contracting authority may consider it inappropriate if the tender relies, for the main part, on the capacities of other entities, or
calls on them for key criteria. If the tender relies on other entities, the economic operator must prove to the contracting authority that it has the resources needed for executing the contract,
for example, by providing a document in which such entities commit to placing said resources at its disposal. Such entities, for example the parent company of the economic operator, must respect
the same rules of eligibility – notably that of nationality – and must fulfil the same selection criteria as the economic operator. Furthermore, the information relating to these third party
entities with regard to the relevant selection criteria must be included in the tender as a separate document. Proof of their capacity must also be furnished when requested by the Contracting
Authority.With regard to technical and professional criteria, a tenderer may only rely on the capacities of other entities where the latter will perform the tasks for which these capacities are
required.With regard to the economic and financial criteria, the entities whose capacities the tenderer uses will become jointly and severally liable for the performance of the contract.Essential
tasksThe contracting authority requires the following essential tasks to be carried out directly by the tenderer itself or, if the tender is submitted by a joint venture / consortium, by one of
its participating members: the siting, installation, and commissioning of equipment.

tender form for supplies contracts included in the invitation to tender dossier, and its format and instructions must be strictly adhered to.Questions regarding this invitation to tender must be

Alger — ALGERIA (noting the publication reference indicated in point 1) at least 21 days before the deadline for the submission of tenders as set out in point 19. The contracting authority must

19.Final date for submission of tendersThe tenderer"s attention is drawn to the fact that there are two different systems for sending tenders; these may be:1) either sent by post or private
courier service;2) or hand delivered.In the first case, the tender must be sent before the deadline for submission, the postmark or deposit receipt being proof (1), and in the second case, the
acknowledgement of receipt given at the time of delivery of the tender will serve as proof.The deadline for submission of tenders is 10.4.2019, at 12:00 – local time.Tenders sent to the
contracting authority after the deadline will not be considered.The contracting authority may, for reasons of administrative efficiency, reject any tender submitted on time to the postal service
but received, for reasons beyond the control of the contracting authority, after the effective date of approval of the evaluation report, if the fact of accepting tenders submitted in time but
